بررسی فقهی حکم ارسال پارازیت بر امواج ماهواره

پارازیت که غالباً در خصوص اختلالات ماهواره‌ای از آن یاد می‌شود، به عنوان یکی از روش‌های جلوگیری از دریافت امواجِ تلویزیون‌های ماهواره‌ای به کار گرفته می‌شود. این مقاله در بررسی فقهیِ این موضوع، به‌ دنبال پاسخ به این سوالات است که: «ادله جواز ارسال پارازیت کدامند؟ شرایط این حکم چیست؟ در خصوص ضررهای احتمالیِ نوعِ مضرّ پارازیت، چه حکمی جریان می‌یابد؟ نقش حاکم اسلامی چگونه است؟».این پژوهش که با گردآوری اطلاعات و داده‌ها از طریق منابع نوشتاری و مکتوب، سامانه‌های رایانه‌ای و نرم‌افزارهای علمی با روش داده‌پردازیِ توصیفی و تحلیلی صورت گرفته است، پس از بیان اقوال و بررسی ادله، به این نتیجه رسیده که دلیلِ وجوب ارسال پارازیت برای جلوگیری از فساد، نهی از منکر است؛ آن ‌هم منوط به عدم ضرر. بنابراین، در ضررهای احتمالیِ پارازیت، با کمک دلیل لاضرر، وجوبِ نهی از منکر برداشته شده و حتی طبق مبنای امام خمینی، حرام خواهد بود؛ البته در مواردِ اهمیت و لزوم نهی از منکر، صرفاً با اذن و تشخیص امام معصوم یا نایب او ممکن است.

The Jurisprudential Study of the Issue of the Transmission of Radio Signals Technically Known as Satellite Jamming

Jamming, often referred to as satellite jamming, is used as one of the methods of blocking reception of transmitted signals of satellite televisions. This article seeks to make a legal study of this issue in order to find an answer to the question, “What are the legal reasons for the use of satellite jamming?” What are the conditions for allowing the use of satellite jamming? Regarding the possible health hazards of satellite jamming of harmful kind, what decision can be made? What would be the role of the Muslim ruler in this connection?Having studied the various statements and reasons for the use of satellite jamming and the collected necessary data from various written sources, computer networks and websites, and scientific soft wares, this research work, drawing upon the descriptiveanalytic method in data processing, has come to this conclusion that the reason for the necessity of the use of satellite jamming is to fight corruption and to put into practice the principle of “forbidding the evil” on condition that the principle of ‘no harm’ is applied. Therefore, in case there is possible health hazard of satellite jamming, due to the Quranic rule of “no harm”, the necessity of practicing the principle of forbidding the evil is removed. The same principle is even considered illegal (ÎarÁm) by Imam Khomeini on the grounds he put his arguments. Of course, it must be noted that the necessity and importance of practicing the principle of “forbidding the evil” is only possible by Infallible Imams’ or their deputies’ recognition and consent.
