مصادیق جدید روابط نامشروع غیر از زنا و مجازات آن در فقه اسلامی و حقوق ایران و افغانستان

رابطه نامشروع غیر از زنا، از دیدگاه عموم فقهای مذاهب اسلامی حرام است و همچنین از نظر قوانین ایران و افغانستان جرم پنداشته شده است و مجازات آن را تعزیر دانسته‌اند. از نظر فقهی رابطه نامشروع غیر از زنا عبارت از رابطه‌ای است که میان مرد و زن برخلاف شرع و قانون صورت می‌گیرد و مستلزم کیفر نیز می‌باشد، در صورتی که به حد دخول نرسد وگرنه زنا محسوب می‌شود. همچنین از نظر قانون هرگاه میان زن و مردی که علقه زوجیت وجود نداشته باشد، رابطه خلاف عرف برقرار شود، رابطه نامشروع گفته می‌شود. باید در نظر داشت که مصادیق روابط نامشروع غیر از زنا حصری نیست، بلکه تمثیلی می‌باشد. برخی از عناوین مجرمانه رایج امروزی، نه در کتب فقهی مذاهب اسلامی و نه در قوانین موجود (قانون مجازات اسلامی ایران و کود جزا افغانستان) مورد توجه قرار نگرفته است. بنابراین نوشتار حاضر در پی آن است که مصادیق جدید و قدیم رابطه نامشروع غیر از زنا را شناسایی نموده و با توجه به مبانی فقهی حقوقی و متفاوت بودن جرم، جزاهای تعزیری آنها را به صورت تطبیقی از دیدگاه فقهای مذاهب اسلامی و حقوق ایران و افغانستان بیان نماید.

New Examples of Illegal Sexual Relationships other than Adultery and Their Punishments in Islamic Jurisprudence and the Law of Iran and Afghanistan

Illegal Sexual Relationship other than Adultery has been forbidden by the jurisprudents of Islamic religions and is still considered a crime under the laws of Iran and Afghanistan and its punishment is Ta‘zir. Jurisprudentially, the Illegal Sexual Relationship other than Adultery is the relationship of a man and woman which is against Shari‘a and law and it entails punishment even if no intercourse has happened, otherwise it is considered adultery. Legally, by law, when there is an unlawful relationship between a man and a woman who has no marital relationship, it is called an illegitimate relationship. It should be borne in mind that illegal sexual relationship other than adultery is not exclusive or limitative (hasri) but it is allegorical (tamthili); some of today’s common criminal offenses have not been addressed in Islamic jurisprudence nor in the existing penal code of Iran and Afghanistan. Therefore, this paper is trying to identify old and recent cases of illegal sexual relationships other than adultery and, considering the legal and jurisprudential principles of crime, express their statutory punishments in a comparative way from the views of Islamic jurisprudents and law of Iran and Afghanistan.
