بررسی تطبیقی تصدی منصب ولایت و رهبری جامعه توسط بانوان در فقه مذاهب اسلامی و حقوق ایران

یکی از مسائل مورد بحث در فقه اسلامی، جواز یا عدم جواز تصدی مناصب ولایی، همچون رهبری حکومت توسط بانوان است. در این نوشتار با روش توصیفی تحلیلی به بررسی تطبیقی این مسئله در فقه مذاهب اسلامی و حقوق ایران پرداخته می‌شود. در فقه مذاهب اسلامی جز یک فرقه (شبیبیه)، همگی قائل به عدم جواز تصدی این منصب توسط زنان می‌باشند. نظام حقوقی ایران به بهترین نحو بین حاکمیت قواعد شرع (اراده خداوند) و قواعد موضوعه (اراده مردم) آشتی برقرار کرده و مدیریت جامعه بر مبنای قواعد شرعی را بر عهده ولی‌فقیه و مدیریت بر مبنای قواعد موضوعه را بر عهده رهبر منتخب مردم قرار داده است و ممنوعیت تصدی زنان را صرفاً در بعد فقهی و آن هم منصب ولایت فقیه برمی‌شمارد. از جهت حقوق موضوعه ممنوعیتی در این خصوص دیده نمی‌شود.

Comparative Study of the Position of Wilayah AlFaqih and Leadership of the Society by Women in Jurisprudence of Islamic Denominations and Iranian Law

One of the issues discussed in Islamic jurisprudence, is permission or the lack of permission for women to hold positions like the leadership of the government. This descriptiveanalytical study paid to comparative study of this issue in Jurisprudence of Islamic Denominations and Iranian Law. In Jurisprudence of Islamic Denominations, except one sect (Shabibiyyah), all consider that women are not authorized to hold this position. In the legal system of Iran, it is best to reconcile the rule of Islamic law (the will of God) and the rule of law (the will of the people) and the management of the society that based on the rules of the Islamic jurisprudence has been placed on Wali alFaqih and management of society that based on the rule of law has been placed on the elected leader of the people. The prohibition of leadership of women has just been put in the jurisprudential aspect, and it is the position of Wilayah alFaqih. There are no prohibitions on the subject in this regard.
