پیامد سرقت توسط نابالغ از نگاه مذاهب فقه اسلامی

این مقاله آثار جزایی ارتکاب سرقت توسط کودک را بررسی می نماید. نظرات فقهای امامیه و اهل سنت پیرامون اجرای حد سرقت بر نابالغ و نیز نحوه تادیب و تعزیر او را تشریح کرده، هدف از اجرای مجازات و نتیجه بروز این مسئله را بیان می‌کند. طبق یافته‌های تحقیق، اولاً: اگر نابالغ برای اولین بار مرتکب سرقت گردد، بنابر اجماع فقهای اسلامی، حد سرقت بر او جاری نمی شود؛ ثانیاً: در صورت تکرار سرقتِ حدی، با توجه به هدف تربیتیِ شارع از این گونه تادیبها، اختیار تام دادرسِ آشنا به مسائل کودکان، برای انتخاب روش تربیت کودک، لازم به نظر می‌رسد. بنابراین با توجه به مصلحت فردی کودک و اجتماعی جامعه و همچنین جلوگیری از تکرار دوباره سرقت، می‌تواند کودک را عفو نماید، یا روشهای دیگر، از جمله روشهای روایی را در پیش گیرد.

Consequences of Theft by Underage According To Islamic Schools

This article studies the Criminal effects of committing theft by Juvenile and discusses the opinions of Islamic jurists including Imamis and Sunnis about execution of Hadd Islamic punishment of theft on underage people, the way of their punishment, the purpose of their punishment and its outcomes. The research findings are: 1) according to all jurists, if the underage person committed theft for the first time he will not be punished by Hadd. 2) If the crime repeats according to educational goals of Islam’s Criminal policy, the judge who is familiar with children’s issues and pedagogy should have full authority to choose the best way for punishing the child. Thus, the judge according to the expediency of the child and benefits of society and also due to prevent the repetition of theft can forgive underage person or use other methods including traditional methods.
