تعبد و تعقل در احکام شرعی از دیدگاه مذاهب اسلامی

مراد از تعبد آن است که احکام معنای غیرمعقول، و مراد از تعقل آن است که احکام معنای معقول داشته باشند. در خصوص تعبدی یا تعقلی بودن نصوص دو نظریه وجود دارد: نخست اینکه نصوص تعبدی هستند و تفسیر مضیق دارند. دوم اینکه نصوص تعقلی هستند و از تفسیر موسع برخوردارند. براساس قواعد اصولی، اصالت در غیرعبادات بر تعلیل است و در عبادات بر تعبد. عبادات از جمله مصادیق احکام تعبدی، و معاملات از جمله مصادیق احکام تعقلی است. در بخش حدود و تعبدی یا تعقلی بودن آن، براساس پژوهش انجام گرفته، از سوی فقها تصریحی صورت نگرفته است. این تحقیق با استفاده از منابع کتابخانه‌ای و با روش توصیفی تحلیلی و با هدف مشخص نمودن مصادیق احکام تعبدی و تعقلی و مفاد این تقسیم بندی و بررسی تطبیقی آنها از دیدگاه مذاهب خمسه و نتیجه مترتب بر آن، سامان یافته است. یافته‌های تحقیق نشان می‌دهد که در احکام عبادات، جنبه تعبد غالب است و اصل بر تعبد است، اما در غیر آنها، اصل بر تعلیل یا همان تعقل است.

Prophecy and reasoning in religious terms from the view of Islamic Sects

The term Ta’abbud means the precepts are unreasonable and the term Ta’aqqul means that the percepts are reasonable. There are two theories concerning the texts to be based on Ta’abbud (Worship) or Ta’aqqul (Reasoning): first) the texts are based on Ta’abbud, therefore, they have a narrow interpretation. Second) they are based on Ta’aqqul, therefore they have a broad interpretation; according to the principles of jurisprudence, in issues about worship, the rules are based on Ta’abbud and in issues other than worship the rules are based on Ta’aqqul. One of the examples of the rules based on Ta’abbud is the worship of God, and of the examples of the rules based on Ta’aqqul are transactions. It should be noted that the jurisprudents have not made any explicit reference to Hudud regarding this issue. This research has been conducted based on the library research and a descriptiveanalytical method aimed at identifying the implications of tangible and conceptual judgments and the implications of this division and their comparative analysis from the viewpoint of the Five Islamic Denominations. The findings of the research show that in issues about worship, the rules are based on worship and in issues other than worship the rules are based on reasoning.
