مطالعه تطبیقی حج نیروهای امنیتی و انتظامی مستقر در حج از منظر فقه مذاهب خمسه

نیروهای امنیتی و انتظامی که هرساله موقع حج، در سرزمین وحی مسئول برقراری امنیت و نظم هستند، در برخی مواقع حین انجام وظایف، خود نیز ممکن است حج بجا بیاورند. حال اگر آنان از سوی مافوق خود، این اجازه را یافتند که حج بجا بیاورند، کیفیت حج آنها و احکام مربوط به آن، با توجه به اشتغالاتی که در آن زمان دارند، چگونه خواهد بود؟ آیا اگر برخی از مناسک را به‌طور کامل بجا نیاورند، یا کامل آن را ترک کنند، حج آنها صحیح خواهد بود یا خیر؟ پژوهش حاضر که با تکیه بر توصیف و تحلیل گزاره‌های فقه مذاهب پنج‌گانه اسلامی و با استفاده از گردآوری داده‌های کتابخانه‌ای در پی جواب به سوالات مذکور برآمده است، روشن می‌سازد که نیروهای امنیتی و نظامی می‌توانند در حین انجام وظیفه حج بجا بیاورند و شرع به آنان این رخصت را داده است که به جای لباس احرام، لباس مخصوص به خود را بپوشند، عرفه را قبل از غروب آفتاب ترک کنند، از مزدلفه پس از مکث کوتاه برگردند، مبیت در منا را به‌کلی ترک کنند، یا فقط در قسمتی از آن حاضر شوند و رمی جمرات خود را به‌جز رمی جمره عقبه باهم در یک یا دو روز جمع کنند و حجشان صحیح می‌باشد.

A Comparative Study of the Hajj Pilgrimage of Security Guards Present in Hajj from the Viewpoint of the Jurisprudence of the Five Islamic Denominations

The security guards who are present at the annual Hajj pilgrimage in Mecca and are in charge of establishing security and order, while performing their duties, may carry out Hajj duty. Yet, the question that rises is that if they are granted the permission by their senior officials to carry out Hajj duty, how will be the quality of their Hajj duty and the related rites, given their commitments and duties at the time, and if they carry out some rites partially, or do not fulfill some of the requirements, will their Hajj duty be accurate or not? Using the description and analysis of propositions of the jurisprudence of the five Islamic Denominations, and collecting data through a library research, the present study attempted to answer the abovementioned questions, and the findings indicated that the security guards can carry out Hajj duty while performing their job duties. The religious law permits them to wear their uniforms as an alternative to Ihram clothing, leave ‘Arafah before sunset, leave Muzdalifah after a short pause, entirely quit staying in Mina, or just be present at some parts of it, and except the final Ramy alJamarat, perform stoning of the devil (Ramy alJamarat) in one or two days. If the security guards perform these, their Hajj duty will be accurate.
