تدابیر پیشگیرانه غیرکیفری از شرط بندی های اینترنتی

زمینه و هدف: اخیراً پدیده ناپسند قمار اینترنتی در بین مردم ایران رواج پیدا یافته،گرچه این رفتار و تمایل عضویت در آن  نوظهور نمی باشد و به قدیم الایام باز می گردد؛ ولی روش انجام آن به تبع پیشرفت و تغییر سبک زندگی سابقه زیادی نداردکه در دنیای شیشه ای فضای مجازی بیش از پیش انجام می گیرد، لذا این معضل به یک نگرانی اجتماعی مبدل گشته که سیاست جنایی و تدابیر پیشگیرانه غیرکیفری خاص خود را می طلبد.روش: گردآوری اطلاعات از طرق استناد به کتب، فرهنگ نامه ها  و منابع حقوقی و مقالات گردآوری شده است. روش تحقیق به صورت کتابخانه ای  و  به صورت توصیفی - تحلیلی انجام گرفته است.یافته ها و نتایج: با تجزیه و تحلیل فنی و آسیب شناسی بر مالباختگان سایبری علت اصلی وقوع این جرم طمع نسبت به پیشنهادات فریبنده مجرمان بدون تفکر و تعقل است. وقتی اقدامی در جهت پیشگیری از وقوع جرم و افزایش امنیت جامعه با برنامه‌ریزی، سازماندهی در میان متولیان امنیت و جرم شناسان صورت پذیرد به یقین نظم اجتماعی، کاهش جرائم، آرامش جامعه و امنیت عمومی بالایی پدید می‌آید. در این میان جرم شناسان باید همانند پزشک حاذق ضمن علت یابی گرایش شهروندان به قماربازی تدابیر پیشگیرانه متناسب با آن ارائه نماید. مهم ترین تدابیر پیشگیرانه در این خصوص رفع معضل بیکاری و فراهم سازی فرصت های شغلی متناسب با شایسته سالاری،تقویت دینداری و اتخاذ تدابیر وضعی توسط پلیس فتا می باشد.

background and purpose: recently, the unpleasant phenomenon of internet gambling has become popular among iranian people, although this behavior and the desire to participate in it is not new and goes back to ancient times. but the method of doing it does not have much history due to the progress and change of lifestyle, which is done more and more in the glass world of virtual space. therefore, this problem has become a social concern that requires its own criminal policy and non-criminal preventive measures.methodology: information has been collected by referring to books, dictionaries, legal sources and articles. the research method has been carried out in a library and in a descriptive-analytical way.findings: with the technical and pathological analysis of cyber criminals, the main cause of this crime is greed for the deceptive offers of criminals without thinking and reasoning. when an action is taken to prevent the occurrence of crime and increase the security of the society by planning and organizing among the security custodians and criminologists, social order, reduction of crimes, peace of the society and high public security will definitely emerge.result: in the meantime, the criminologist should, like a smart doctor, find the cause of citizens’ tendency to gamble and provide appropriate preventive measures. the most important preventive measures in this regard are solving the problem of unemployment and providing job opportunities according to meritocracy, strengthening religiosity and adopting situational measures by fata police.
