سازوکارهای پیشگیری از جرم ترک نفقه در نظام حقوقی ایران

زمینه و هدف: یکی از ضروریات عقد نکاح تکلیف پرداخت نفقه از سوی مرد است. به دلیل اهمیت این امر قانونگذار، عدم پرداخت نفقه را جرم انگاری نموده و برای آن مجازات تعیین نموده است. اما از پیشگیری از جرم بهتر از مجازات آن است لذا این سوال مطرح است که چه راهکارهای پیشگیرانه ای در قبال جرم ترک نفاق وجود دارد؟روش: این پژوهش از نظر هدف کاربردی و به لحاظ گردآوری اطلاعات به روش اسنادی و از طریق مطالعه قوانین و منابع معتبر انجام شده و اطلاعات به دست آمده به صورت توصیفی- تحلیلی مورد تجزیه وتحلیل قرار گرفته است.یافته ها و نتایج: قانون گذار ایران همواره به موضوع نفقه به عنوان یک امر دو وجهی که هم دارای ماهیت حقوقی و هم دارای ماهیت کیفری است پرداخته است. در جرم ترک انفاق برای اینکه شوهر به دلیل نفقه ندادن مجازات شود، باید با وجود استطاعت مالی و وضع اقتصادی مناسب، از انجام وظیفه خودداری کند. البته در صورتی که شوهر ثابت کند که زن از وی تمکین نمی کرده است، نه تنها مجازاتی در انتظار او نخواهد بود، تکلیف پرداخت نفقه از گردن او ساقط می شود. در خصوص راهکارهای پیشگیری اجتماعی از جرم ترک نفقه می توان به موارد متعددی از جمله تلاش برای تحکیم بنیان های عاطفی خانواده، تقویت باورهای دینی، اقدامات آموزش محور در مدارس و از طریق رسانه ها و همچنین اصلاح ساختار اقتصادی اشاره نمود.

background and purpose: one of the debates in environmental health is the collection, disposal, and burial of hospital waste, including operating rooms, injections, blood banks, dialysis, out-of-date drugs, bloody cloths and clothes, as well as garbage. sharp and sharp objects such as surgical blades, dialysis filters, catheters, urine bags, etc., which are dangerous infectious wastes and one of the serious problems of the environment in the past few years, are still performed in traditional and unhygienic ways in many parts of the country. and this issue has brought irreparable damages so far, this research is presented with the aim of non-criminal countermeasures and preventive measures against environmental hazards caused by hospital wastes.method: the present research was conducted using a descriptive and analytical method.findings and results: the importance of prevention on the one hand and the increase in environmental hazards caused by hospital waste on the other hand led to the investigation of this research that non-criminal solutions such as the basic separation of waste from one another, sanitary burial method, training to personnel and employees in the direction separation of wastes and risk of virus transmission, preventive risk management method and coordination between relevant bodies in waste management have been evaluated and analyzed in order to reduce environmental risks caused by hospital wastes.
