پیشگیری اجتماعی از رفتارهای بزهکارانه مرتبط با رمز ارزها

زمینه و هدف: امروزه یکی از جرایم نوین که در پی شیوع استفاده از فضای مجازی رواج یافته، جرایم مرتبط با رمز ارزها است. در این راستا، ابتدا باید وضعیت قانونی و ماهیت رمز ارزها مشخص شود؛ سپس، چارچوب مقرره‌گذاری و ابعاد گوناگون آن ترسیم و از این مسیر راهبردهای لازم برای تقویت سامانه‌های پیشگیرانه مورد مطالعه و بررسی قرار گیرد. از این رو، در پژوهش ابتدا به مفهوم‌شناسی رمز ارزها و سپس، به ارائه راهکارهای پیشگیری اجتماعی از رفتارهای بزهکارانه مرتبط با رمز ارزها پرداخته شده است.روش: تحقیق حاضر از نوع مطالعات تحلیلی و توصیفی به صورت کتابخانه‌ای- اسنادی انجام شده است.یافته‌ها و نتایج: پیشگیری اجتماعی مبتنی بر علت‌شناسی بزهکاری است؛ از این رو، برای پیشگیری اجتماعی از رفتارهای بزهکارانه مرتبط با رمز ارزها باید ابتدا بر مبنای نظریه های جرم‌شناسی به علت این نوع بزهکاری‌ها پرداخت. از این رو، از مهم ترین نظریه‌ها در این زمینه می توان به نظریه های جرم‌شناسی آبی و نظریه گذار از فضا اشاره نمود. مهم‌ترین راهکارهای پیشگیری اجتماعی از از رفتارهای بزهکارانه مرتبط با رمز ارزها به واسطه  آموزش و ارتقاء سطح آگاهی های عمومی، تجهیز رسانه ای و نقش آن ها، فرهنگ سازی استفاده صحیح از رمز ارزها و مقررات گذاری پیشگیرانه انجام خواهد شد.

background and purpose: today, one of the new crimes that has become popular due to the spread of cyberspace is the crimes related to cryptocurrencies. in this regard, first the legal status and nature of cryptocurrencies must be determined; then the regulatory framework and its various dimensions will be drawn and from this path, the necessary strategies to strengthen the preventive systems will be studied and investigated, therefore, in the research, firstly, the conceptualization of cryptocurrencies and then the presentation of social prevention strategies from criminal behaviors related to cryptocurrencies have been paid.method: the current research was conducted as an analytical and descriptive study in a library-document format.findings and results: social prevention is based on the etiology of crime, therefore, for the social prevention of criminal behavior related to cryptocurrencies, it is necessary to first deal with the causes of this type of crime based on criminological theories, hence the most important theories in this field can be referred to the theories of water criminology and the theory of the transition from space. the most important social prevention solutions from criminal behaviors related to cryptocurrencies will be done through education and raising the level of public awareness, equipping the media and their role, creating a culture of correct use of cryptocurrencies and preventive regulations.
