جایگاه پدیده افشاگری در پیشگیری از جرایم دولتی

زمینه و هدف: جرم دولتی در راستای منفعت دولت و به ضرر جامعه است که می‌تواند مشمول حقوق بنیادین اشخاص، محیط زیست، سلامتی، حقوق بشر و غیره باشد. اما مهم‌ترین مسئله در اینجا افشای این گونه جرایم است.  در واقع چون قدرت اجرایی و تعقیب جرایم در اختیارات دولت بوده و دولت تعیین کننده در سطح بالا دستی کشور قرار دارد، نمی توان انتظار داشت که هم چون دیگر جرایم از طریق نهادهای دولتی کشف شود. سوال اصلی در راستای هدف تحقیق این بوده است که جایگاه افشاگری در جرایم دولتی چیست؟روش: تحقیق ﺣﺎﺿر به صورت ﺗﻮصیفی و تحلیلی اﺳﺖ و داده‌های ‌مربوط ﺑﻪ ﺷﻴﻮۀ اﺳﻨﺎدی و با واکاوی دقیق جمع‌آوری و مورد تجزیه و تحلیل قرار گرفته ‌است. یافته‌‌ها و نتایج: اکثر جرایم دولتی از طریق افشا اعیان می‌گردد. این افشاگری ممکن است به دست مطبوعات، افراد بالادستی و یا حتی از طریق اشخاص درون دولت انجام گیرد. می‌توان نتیجه گرفت که افشاگری می‌تواند جایگاه پیشگیرانه‌ای را در جرایم دولتی ایفا کند.

state crime is in the interest of the state and to the detriment of the society, which can be subject to the fundamental rights of individuals, environment, health, human rights, etc. but the most important issue here is the disclosure of such crimes. in fact, because the executive power and the prosecution of crimes are in the hands of the government and the determining government is at the highest level of the country, it cannot be expected that it will be discovered through government institutions like other crimes. in this way, most government crimes are revealed through disclosure. this disclosure may be done by the press, high-ranking people or even through people in the government. our question in line with the purpose of the research is what is the position of disclosure in state crimes? it seems that disclosure can play a preventive role in state crimes. in a summary of our results, our hypothesis has been proven and the main role of whistleblowing in state crimes is the role of its predecessor. the current research is qualitative and descriptive-analytical in terms of implementation method. the related data has been collected and analyzed in a documentary way and with a detailed analysis.
