پیشگیری از جرائم علیه امنیت سایبری در هوانوردی بین المللی

زمینه و هدف: صنعت هوانوردی بین‌المللی به عنوان یکی از صنایع زیرساختی مهم که پیوندی ناگسستنی با تجارت و حمل ‌و ‌نقل بین‌المللی دارد؛ هدفی جذاب برای مجرمین به شمار می‌رود. همگام شدن این صنعت بزرگ با رشد فناوری اطلاعات که ماحصل آن پیدایش فضای ناملموس و پیچیده‌ای چون فضای مجازی می‌باشد و همچنین وابستگی روزافزون صنعت هوانوردی به این پدیدة نوظهور، زمینه را برای ایجاد خطرات و تهدیدات جدی علیه صنعت هوانوردی فراهم آورده است؛ اما پیشرفت فناوری و وابستگی صنعت هوانوردی به آن، نباید مانعی برای امنیت صنعت هوانوردی گردد. ایجاد و توسعة یک چارچوب حقوقی متقن برای سامان‌دهی و ایجاد نظم در این رابطه، نظارت و پیشگیری از خطرات و تهدیدات علیه آن و مقابله با مجرمین این جنایت و مجازات آنها امری بسیار ضروری است.روش: پژوهش حاضر با روش توصیفی و تحلیلی نگارش یافته است.یافته‌ها و نتایج: با مطالعة اسناد و منابع به این مهم دست ‌یافتیم که علی‌رغم تلاش‌های صورت گرفته، مقررات پراکنده موجود برای مقابله با حملات سایبری کافی نبوده و تنها راه برای مقابله با این تهدیدات و پیشگیری از جرائم سایبری علیه هوانوردی، یافتن راه‌حلی جهانی می‌باشد. با اعمال اصل صلاحیت جهانی نسبت به حملات سایبری مخرب که جامعة هوانوردی بین‌المللی را هدف قرار داده است، تدوین‌کنندگان مقررات و جامعة جهانی بهتر می‌توانند مجرمین سایبری را مسئول جرم خود دانسته و به تضمین «صلح و امنیت بین‌المللی» کمک نمایند.

Prevention of crimes against cyber security in international aviation

International aviation industry, as one of the most important infrastructural industries that has an essential and inseparable link with international trade and transportation, is an attractive target for cyber criminals. The synchronization of this large industry with the growth of information and communication technology, which results in the emergence of intangible and complex spaces such as cyberspace, as well as the growing dependence of the aviation industry on this emerging and growing phenomenon, creates the ground for serious risks and threats against the aviation industry. But the advancement of technology and the dependence of the aviation industry on it should not be an obstacle to the security of the aviation industry as the safest method of transportation and one of the important industries related to the world trade. Establishing and developing a strong and sound legal framework for organizing and establishing order in this regard, monitoring and preventing dangers and threats against it, and confronting the perpetrators of this crime and punishing them is essential. Therefore, in this descriptiveanalytical study, we seek to examine the legal resources available in this area to determine the extent to which international aviation regulations are deterrent against cyber attacks against aviation security. By studying the documents and sources, we came to the conclusion that despite the efforts made, the existing scattered regulations are not enough to counter cyber attacks, and the only way to deal with these threats is to find a global solution.
