پیشگیری غیرکیفری از جرم در آموزه های اسلامی با تاکید بر صحیفه سجادیه

زمینه و هدف: پیشگیری غیرکیفری یا کنشی نوعی از پیشگیری است که حوزه‌ی عملکرد و بررسی آن مربوط به قبل از وقوع جرم می‌باشد. امروزه از نقطه نظر بدیهیات عقلی، سودمندی تدابیر پیشگیرانه‌ی کنشی و غیرکیفری و ناکارآمدی کیفر و مجازات، بر اندیشمندان عرصه‌ی جرم‌شناسی واضح گردیده و از آن به عنوان یک راهبرد متعارف و خردمندانه تعبیر می‌شود که در حال پویایی و گسترش است. تلاش سیاست‌گذاران حقوق نیز در راستای افزایش بهره‌وری و روزآمد نمودن و استفاده‌ی حداکثری از این اقدامات پیشگیرانه‌ی کنشی استوار گردیده است.روش: پژوهش حاضر با روش توصیفی و تحلیلی انجام شده است.یافته‌ها و نتایج: با تدقیق در در آموزه‌‌های اسلامی خصوصاً کتاب صحیفه سجادیه که گنجینه‌ای فاخر از معرفت و شناخت اصولِ بنیادین زندگی است، این مهم بدست می‌آ‌ید که اسلام در زمینه‌ی پیشگیری از وقوع بزهکاری در ابتدا به مقوله‌ی غیرکیفری تاکید داشته است. بدین ترتیب که متولیان امور کشور با فراهم نمودن شرایط مناسب اجتماعی، فرهنگی، اقتصادی و سیاسی، همواره بر سرعت بخشیدن و یا کند نمودن این روند تاثیر خواهند گذاشت. براساس آنچه مطرح شد این مقاله سعی داشته است که با بررسی آموزه‌های صحیفه سجادیه، دیدگاه امام (ع) را نه ‌فقط به عنوان یک الگوی پیشگیرانه‌‌ از‌ جرم، بلکه یک برنامه جامع تربیتی و پرورشی در ابعاد مختلف اعتقادی و رفتاریِ افراد جامعه‌ به رشته‌ی تحریر درآورد.

Non-criminal prevention of crime in Islam from the perspective of Sahifa Sajjadieh

Background and Aim: Noncriminal or action prevention is a type of prevention whose field of action and investigation is related to the precrime. Today, from the point of view of rational axioms, the usefulness of preventive measures of action and nonpunishment and the inefficiency of punishment and punishment have become clear to thinkers in the field of criminology and it is interpreted as a conventional and wise strategy that is dynamic and expanding. The efforts of legal policymakers have also been based on increasing productivity, updating and maximizing the use of these preventive measures.Methodology: The present study was conducted by descriptive and analytical methods.Findings and Results: By examining the Islamic teachings, especially the book Sahifa Sajjadieh, which is a glorious treasure of knowledge and understanding of the basic principles of life, it is important to obtain that Islam in the field of crime prevention initially emphasized the noncriminal category. Thus, those in charge of the country’s affairs will always accelerate or slow down this process by providing appropriate social, cultural, economic and political conditions. Based on what has been presented, this article has tried to examine the teachings of Sahifa Sajjadieh, the view of Imam (AS) not only as a preventive model of crime, but a comprehensive educational program in various dimensions of belief and behavior of society in the field.
