سیاست کیفری ایران در پرتو آموزه های جرم شناسی راست جدید با تاکید بر امنیت در نظام فرهنگی

زمینه و هدف: سیاست کیفری مبتنی بر راست نو، با اعتقاد به ناکارآمد بودن سیاست‌های پیشگیرانه‌ی بالینی، مهار جرایم را تنها از گذر سختگیری کیفری ممکن می‌داند، سیاست های نئولیبرالی جناح راست، طی فرایند جهانی شدن، تاثیر خود را بر سیاست عمومی دولت ها و در نتیجه نظام عدالت کیفری نهاده است. دولت ها در ایران، در بحران های اقتصادی، راهی جز جهت گیری به نظام سرمایه داری و اتخاذ راهکارهای سیاسی، اقتصادی نئولیبرال ندیدند، این در حالی است، که توسعه اقتصادی بر مبنای اقتصاد آزاد، سبب خلق نظامِ ارزشیِ «سرمایه داری لیبرال» شده و شقوق فرهنگی اجتماعی کشور را، دستخوش تغییراتی  قرار داده است، از این نظر، رویکرد امنیت مداری سیاست کیفری، به حوزه فرهنگ نیز تسری پیدا کرده است. البته عواملی چون تمایلات عوامگرایانه و توده گرا نیز، در سختگیری کیفری درحوزه فرهنگ، بی تاثیر نبوده اند. روش‌شناسی: در این تحقیق از روش توصیفی تحلیلی به عنوان روش پژوهشی استفاده شده است و ابزار گرد آوری داده‌ها ی کتابخانه ای و اسنادی است. یافته ها و نتیجه گیری : یافته های پژوهش حاکی از آن است که ارتباط معناداری میان سیاست کیفری ایران و اندیشه جرم شناسی راست نو، مبتنی بر سیاستگذاری های اقتصادی وجود دارد.

Iranian Criminal Policy in the Light of New Right CriminologyWith an emphasis on security in the cultural system

Criminal policy based on New Right thinking, believing that clinical preventive policies are ineffective, views crime prevention as only possible through a severe criminalization, The rightwing neoliberal policies, in the process of globalization, have had an impact on the public policy of governments and consequently on the criminal justice system. Governments in Iran, in economic crises, saw no other way than to turn to the capitalist system and adopt neoliberal economic, political solutions, while free economic development created a liberal capitalist value system. And it has changed the cultural and social dimensions of the country. In this respect, the security approach of criminal policy has also extended to the field of culture. Of course, factors such as populist and massoriented tendencies have also had no effect on the criminalization of culture. The findings of the study indicate that there is a significant relationship between Iran’s criminal policy and the idea of modern rightwing criminology based on economic policy making. This research is applied in terms of its purpose and in terms of its nature and method, it is descriptiveanalytical, the necessary information is gathered and analyzed in citation and library.
