موانع ساختاری و تشکیلاتی شوراهای اسلامی در ایران و راهکارهای رفع این موانع

شوراهای اسلامی شهر و روستا و شوراهای بالادست از جمله نهادهای اساسی خاص در نظام جمهوری اسلامی ایران به شمار می‌آیند که بر مبنای نظام عدم تمرکز اداری تشکیل شده‌اند. علی‌رغم اهمیت ویژه‌ای که قوانین اساسی و عادی برای این شوراها قائل شده‌اند و با وجود فرصت‌ها و ظرفیت‌های قانونیِ این نهادهای نوپا در انجام وظایف و اختیارات خود، شوراهای مذکور با مشکلات و آسیب‌های متعددی مواجه بوده‌اند. در این میان، موانع حقوقی شوراها از نظر ساختار و تشکیلات، قابل‌بررسی جداگانه است. تعارض اصول قانون اساسی در خصوص ساختار و جایگاه شوراهای اسلامی و دیده‌نشدن خصایص لازم برای یک نهاد محلی در قوانین عادی، از جمله اساسی‌ترین موانع ساختاری پیش روی شوراهای اسلامی محسوب می‌شوند. لذا ارائه نظر تفسیری توسط شورای نگهبان از اصول قانون اساسی در راستای واگذاری تصمیم‌گیری و اداره امور محلی به شوراها، استفاده از ظرفیت‌های حقوقی موجود شوراها و تلاش مجلس شورای اسلامی در وضع قوانین مناسب در راستای تقویت جایگاه شوراها ضروری است.

Structure and Organization Obstacles of Islamic Councils in Iran and Solutions

Islamic urban and rural councils and upperhand councils are among special fundamental institution in Islamic republic of Iran that have been founded based on the system of decentralization. Despite the particular importance attached to Islamic councils by constitutions and ordinary laws and the fact that this newly establish has had opportunities and capacities for doing its duties and powers, this councils have faced several challenges in the face of those opportunities.in this respect legal obstacles of councils can be studied separately in terms of structure and organization. Conflict articles of constitutions concerning structure and status of Islamic councils and the lake of necessary features for a local institution in ordinary laws are considered as one of the most fundamental structural barriers facing Islamic councils. It seems necessary for the guardian council to provide an interpretation of the constitution in line with relegation of decision making and administration of local affairs to councils, using legal capacities of councils present and effort of Islamic council assembly in enacting of appropriate laws in line with reinforcing the position of council.
