شمولیه قاعده لاضرر فی الاحکام العدمیه و تعویض الخساره

تعدّ قاعده لاضرر من اهم القواعد الفقهیه التی تستخدم فی جمیع الابواب والبحوث الفقهیه. لا شک انّه یمکن القضاء علی الاحکام الموذیه من خلال هذه القاعده. اما اذا حدث ضرر بسبب عدم وجود الحکم فهناک خلاف حول امکانیه تزویر هذا الحکم بالاستناد الی هذه القاعده. وجوب تعویض الضرر هو موضوع عقلی والعقل لا یقوم بای فرق بین الامور الوجودیه والعدمیه. اضافه الی ذلک ومن خلال الاشاره الی العرف، یمکن فهم هذا الموضوع؛ ای وجوب تعویض الامور الضرریه والعدمیه ایضاً. تنطبق اسباب ابواب قاعده لاضرر ایضاً علی حقیقه وجوب التعویض؛ ای ضرر؛ سواء کان وجودیاً او عدمیاً. اما بالنسبه الی مساله تعویض الضرر ومدی شمولیتها لقاعده لاضرر ؛ فانّ ذلک علی اساس نظریتی نفی الضرر غیر المتدارک والنهی التشریعی، وهو تعویض صریح للخساره؛ کما تتعلق احکام اقسام القانون بشان الاضرار بحقیقه وجوب تعویض ای اضرار، سواء کانت وجودیه او غیر موجوده.

Comprehensiveness of No Harm Rule in Absentia Judgment and Compensation

The paper deals with the comprehensiveness of principle of prohibition of detriment in the situations of lack of rules and mitigation of damage. The noharm/damage rule is one of the most important jurisprudential rulings that are used in all juridical sections and researches. There is no doubt that harmful verdicts can be removed through this rule. But if damage is caused due to not rendering of judgment, there is disagreement about making up a judgment according to this rule. Obligation for making good a loss is a mental issue and reason does not make difference between existential and nonexistence affairs. Moreover, by referring to the custom, it is understood that the obligation of compensation of affairs is uncommon. The contents of the law of damage are also related to the reality that any kind of damage, whether existential or else, must be compensated.
