چکیده
|
اهداف و زمینهها: هدف این پژوهش بررسی و مقایسه تطبیقی توسعه پایدار مناطق عشایری کشور از دیدگاه قواعد حقوقی در دوران پیش و پس از انقلاب اسلامی ایران بوده است.روششناسی: این تحقیق، از نوع توصیفی و تحلیلی است که به شکل مطالعه عمیق صورت گرفته است. در بخش اول، اقدام به گردآوری اطلاعات پایه درباره وضعیت عشایر (جمعیت، پراکنش و درصد) در دوران پیش و پس از انقلاب گردید. سپس؛ قوانین و مقررات مرتبط که در هر دوره وضع شده بودند، استخراج و مورد مقایسه قرار گرفتند. همچنین؛ مقایسه تطبیقی میان شاخصهای توسعه پایدار عشایر در دو دوره مورد مطالعه صورت گرفت. بدین منظور، از رویکرد و دستورالعمل بانک جهانی برای سنجش شاخصهای توسعه پایدار استفاده گردید. یافته ها: توسعه پایدار مناطق عشایری در دوران پیش از انقلاب از فراز و نشیب بیشتری برخوردار بوده است. در حالیکه در دوران پس از انقلاب تلاطم در برنامهریزی و وضع قوانین کمتر به چشم میخورد. از سوی دیگر، برخی از شاخصهای توسعه پایدار از وضعیت مطلوبتری برخوردار بودهاند. بهطور مثال: تامین سرمایه توسط جامعه محلی، سطح درآمد، سلامت اکوسیستم طبیعی و بهرهمندی از منابع طبیعی. در حالیکه در دوران پس از انقلاب، شاخصهایی نظیر: وجود قاعده حقوقی، حضور در اجرای برنامههای توسعه، ارایه طرح و برنامه به دولت، سطح بهداشت، سطح سواد و نقش موثر در اقتصاد ملی در وضعیت بهتری قرار دارند.نتیجه گیری: نتایج بیانگر آن است که با وجود قوانین مترقی همچون اصل پنجاهم قانون اساسی، قواعد حقوقی فعلی، برای ارتقای متوازن شاخصهای توسعه انسانی، محیط زیستی و اقتصادی در مناطق عشایری ناتوان هستند.

Abstract
|
Aims Backgrounds: The aim of this study was to compare the sustainable development of nomadic areas of the country from the perspective of legal rules in the period before and after the Islamic Revolution of Iran.Methodology: This research is descriptive and analytical in the form of an indepth study. In the first part, basic information about nomadic status (population, distribution and percentage) was collected before and after the revolution. Then; relevant rules and regulations that were enacted in each period were extracted and compared. Also; a comparative comparison was made between the indicators of sustainable nomadic development in the two studied periods. Therefore, the World Bankchr('39')s approach and guidelines were used to measure sustainable development indicators.Findings: Sustainable development of nomadic areas during the prerevolutionary period has varied. While in the postrevolutionary period, there is less turmoil in planning and formulating laws. On the other hand, some indicators of sustainable development have been more favorable. For example: Capital financing by the local community, income level, natural ecosystem health and natural resource utilization. While in the postrevolutionary period, indicators such as the existence of legal rules, participation in the implementation of development programs, the presentation of plans and programs to the government, the level of health, literacy and effective role in the national economy are better.Conclusion: The results show that despite progressive laws such as Article 50 of the Constitution, the current legal rules are incapable of balancing the indicators of human, environmental and economic development in nomadic areas.
