واکاوی سیاست جنایی تقنینی ایران در مقابله با جرائم مالی کارکنان دولت

زمینه و هدف: جرایم مالی کارکنان دولت ازجمله جرایمی است که ضمن بی‌ثباتی نظم و امنیت اقتصادی، موجب بی‌اعتمادی مردم به نهادهای حاکمیت می‌شود. سیاست جنایی ایران نیز در بعد تقنینی به مقابله با این جرم پرداخته که در این پژوهش ضمن واکاوی مفهوم جرم مالی، به بررسی این امر می‌پردازیم که سیاست جنایی تقنینی ایران در مقابله جرم فساد مالی کارکنان دولت از چه حدود و ابعادی برخوردار است؟روش: این پژوهش از نظر هدف، کاربردی و به لحاظ گردآوری اطلاعات به روش اسنادی و از طریق مطالعه قوانین و منابع معتبر انجام شده و اطلاعات به‌دست ‌آمده به‌صورت توصیفی- تحلیلی مورد تجزیه ‌و تحلیل قرارگرفته است.یافته‌ها و نتایج: در ایران، مبارزه با جرایم مالی کارکنان دولت در مقاطع مختلف زمانی و با اهداف گوناگون مطرح ‌شده است، اما قلمرو سیاست جنایی ایران در خصوص جرایم ارتکابی کارکنان دولت بعد از پیروزی انقلاب اسلامی و استقرار حکومت اسلامی از یک ‌طرف و پیش‌بینی رفتارهای مجرمانه جدید از طرف دیگر در مقایسه با قوانین قبل از انقلاب متحول و توسعه ‌یافته است. سیاست جنایی تقنینی ایران در قبال جرایم مالی کارکنان دولت با رویکرد کیفری و مجازات محور بوده و به‌طور محدود رویکرد غیرکیفری را نیز در پیش‌گرفته است.

an analysis of iran’s legislative criminal policy in combating the financial crimes of government employees

background and aim: financial crimes of government employees are among the crimes that, while destabilizing economic order and security, cause people to distrust government institutions. iran’s criminal policy has also dealt with this crime in a legislative dimension. in this study, while analyzing the concept of financial crime, we examine the extent and dimensions of iran’s legislative criminal policy in combating the crime of corruption of government employees?method: this research has been done in terms of practical purpose and in terms of collecting information by documentary method and by studying valid laws and sources and the obtained information has been analyzed descriptively-analytically.findings and results: in iran, the fight against financial crimes of government employees has been discussed at different times and with different goals, but the realm of iranian criminal policy regarding crimes committed by government employees after the victory of the islamic revolution and the establishment of islamic government on the one hand and before the nose of new criminal behaviors, on the other hand, has evolved compared to pre-revolutionary laws. iran’s legislative criminal policy towards the financial crimes of government employees has a criminal and punitive approach and to a limited extent has taken a non-criminal approach.
