کشف جرائم تروریستی از طریق فناوری نوین با تاکید بر اقدامات اتحادیه اروپا

زمینه و هدف: تروریسم را می‌توان به عنوان یک پدیده نسبتاً پیچیده مطرح نمود که جلوه‌های آن مدام در حال تغییر است و این پدیده در طول تاریخ با نظام قدرت و ساختارهای قدرت‌گرا ارتباطی تنگاتنگ داشته است. همچنین پیشرفت فناوری توانسته شیوه‌های کشف جرم خصوصا جرائم مهم مانند جرائم تروریستی را متحول نماید. اتحادیه اروپا در این زمینه دستاوردهای مهمی داشته که بر این مبنا در این پژوهش به این امر می‌پردازیم که پیشرفت فناوری چه تاثیری بر کشف جرائم دارد و این امر را با تاکید بر دستاوردهای اتحادیه اروپا بررسی می‌کنیم. روش: این پژوهش به صورت توصیفی- تحلیلی مورد تجزیه وتحلیل قرار گرفته است. یافته‌ها و نتایج: در خصوص جرم‌انگاری تروریسم در اسناد اتحادیه اروپا باید گفت که اتحادیه اروپا در حوزه حقوق کیفری به موجب معاهده اتحادیه اروپایی سعی نمود مقابله با تروریسم را قاعده‌مند نماید. راهبردهای اتحادیه اروپا در کشف جرائم تروریستی شامل راهبردهای تقنینی در مقابله با جرائم، اقدامات یوروپل در کشف جرائم تروریستی و اقدامات فرانتکس می‌باشد. راهبردهای تقنینی در مقابله با جرائم شامل تصویب کنوانسیون اروپایی راجع به سرکوبی تروریسم (1977)، اتخاذ سیاست موضع مشترک در مبارزه با تروریسم (2001) و چارچوب تصمیم‌گیری شورا در احصاء جرائم تروریستی است. همچنین اقدامات یوروپل در کشف جرائم تروریستی شامل تاسیس آزمایشگاه با فناوری مدرن، تدوین استراتژی یوروپل در کشف جرائم (2020)، اقدامات سازمان مدیریت مرزهای اتحادیه اروپا (فرانتکس)، اقدامات ناتو و امکان دسترسی فرامرزی به مدارک الکترونیکی است. این نهادها با بهره‌گیری از فناوری مدرن توانسته‌اند در کشف جرائم خصوصاً جرائم تروریستی کارآمد عمل نمایند.

background and purpose: terrorism can be considered as a relatively complex phenomenon whose manifestations are constantly changing and this phenomenon has been closely related to the power system and power-oriented structures throughout history. also, the advancement of technology has been able to transform the methods of crime detection, especially important crimes such as terrorist crimes. the european union has made important achievements in this field, and on this basis, this research, we will discuss what effect does the advancement of technology have on the detection of crimes?findings and results: regarding the criminalization of terrorism in the documents of the european union, it should be said that the european union tried to standardize the fight against terrorism in the field of criminal law by virtue of the european union treaty. the european union’s strategies in detecting terrorist crimes include legislative strategies in dealing with crimes, europol’s actions in detecting terrorist crimes, and frontex actions. the legislative strategies in dealing with crimes include the adoption of the european convention on the suppression of terrorism (1977), the adoption of a common position policy in the fight against terrorism (2001) and the council’s decision-making framework in the statistics of terrorist crimes. also, europol’s actions in detecting terrorist crimes include the establishment of a laboratory with modern technology, the formulation of europol’s crime detection strategy (2020) and the actions of the european union border management organization (frontex). using modern technology, these institutions have been able to work efficiently in detecting crimes, especially terrorist crimes.
