چالش های حقوقی و پلیسی نظارت بر مجرمان سابقه دار

امروزه پدیده بزهکاری در جامعه به عنوان دغدغه اصلی همه کسانی است که به نوعی با بزه در ارتباط هستند. همه در تلاشند تا به نوعی آمار جرم کاهش یابد یا حداقل افزایش نیابد و از موضوعاتی که در سال ها ی اخیر، مورد توجه خاص جرم شناسان قرار گرفته است، نظارت بر مجرمان، به ویژه مجرمان سابقه دار است. این نظارت ها با هدف حفاظت جامعه در برابر جرائم شدید مجرمان سابقه دار اِعمال می شود و می تواند زمینه ساز بروز چالش های حقوقی و پلیسی شود. با توجه به اینکه تحقیقات موجود، کمتر به موضوع چالش های نظارت بر مجرمان پرداخته اند یا با اتکا به منابع خارجی، صرفاً به دغدغه ها و موانع به کارگیری یکی از جلوه های نظارت اشاره کرده اند لذا مقالۀ حاضر با هدف بهره گیری از قوانین موضوعه ایران و تکیه بر نتایج حاصل از تحقیقات پلیسی به دنبال بیان مهم ترین چالش های نظارت بر مجرمان سابقه دار و ارائه راهکار نسبت به رفع آن برآمده است.حاصل نتایج تحقیق حاضر این است که موضوع نظارت بر مجرمان سابقه دار از جهات مختلف ازجمله مفهومی، به دلیل فقدان معیار یا مصادیق قانونی جرم و مجرم سابقه دار و تبیین امکانات ونیازهای پلیس وکم و کیف آن ها و همچنین از جهت قانونی و اجرایی با کاستی ها و مشکلات زیادی مواجه است. ازاین رو ضمن تبیین مفهوم نظارت، راهکارهای ارائه تعریف قانونی و مصادیق جرم و مجرمان سابقه دار و برای تقویت نقش مجریان در کنترل مجرمان سابقه دار ، پیش بینی تدابیر نظارتی مانند تشکیل بانک اطلاعاتی ، ثبت اطلاعات در این مقاله ارائه شده است.

legal and police challenges of supervising chronic offenders

nowadays the phenomenon of delinquency in the society is the main concern of those who are somehow related to delinquency. everyone is trying to mitigate crime rate or prevent it from increasing and one of the issues that has caught the attention of criminologists in recent years is supervising offenders, especially chronic offenders. these supervisions are carried out with the aim of safeguarding the society against serious crimes of chronic offenders and can set the stage for legal and police challenges. in regard to the fact that the present studies have paid little attention to supervising offenders or by relying on foreign sources, they have merely pointed out to concerens and hurdles of applying one of the features of supervison, therefore; the present article is intended to pursue mentioning the most important challenges of supervising chronic offenders using iran’s related laws and depending on results obtained from police studies and finally, it presents a solution to eliminate this problem.the results of the present research show that the issue of supervising chronic offenders faces a number of pitfalls and problems from different aspects such as conceptual ones due to the lack of legal criteria or examples of offense and chronic offenders and determining the quantitative and qualitative capabilities and needs of police and from legal and executive perspectives, as well. therefore; while determining the concept of supervision, solutions have been provided for legal definition and examples of offense and chronic offenders and in order to augment the role of law enforcement agents in controlling the chronic offenders, supervisory precautions such as establishing data bank and registering data have also been presented in this reaserch.
