واکنش جنایی نسبت به جعل های پیچیده ی رایانه ای در سیاست کیفری ایران

زمینه و هدف: جعل‌های پیچیده‌ رایانه‌ای (دین فیک‌ها) یکی از فناوری‌های مجازی است که نرم‌افزارهای مورد استفاده در این فناوری امکان ساخت انواع فیلم‌ها، تصاویر و اصوات دستکاری شده و غیرواقعی را فراهم می‌سازد. این فناوری می‌تواند محصولاتی را نیز خلق نماید که چالش‌هایی جدی و بعضاً مجرمانه را با خود به همراه داشته باشد و شیوع چنین فناوری، انتشار اطلاعات غیرواقعی را ایجاد می‌کند. در چنین شرایطی این سوال مطرح می‌شود که نظام کیفری ایران چه سیاستی را نسبت به دیپ فیک‌ها اتخاذ کرده است.روش: این تحقیق از نوع هدف، کاربردی و روش انجام تحقیق توصیفی- تحلیلی است.یافته‌ها و نتایج: این تحقیق نتیجه می‌گیرد با توجه به جدید بودن این فناوری در قوانین مرتبط با جرایم رایانه‌ای به‌طور خاص به این پدیده پرداخته نشده است. با این حال قوانین ایران اَشکال مختلفی از این دست از جعل‌های رایانه را تحت پوشش قرار می‌دهند، امّا تفکیک مناسبی میان انواع دیپ فیک با توجه به محتوا و هدف از ساخت آنها صورت نگرفته است و در عین‌ حال اقدامات مرتبط همچون انتشار و ترویج آنها نیز به شکل نظام‌مندی جرم‌انگاری نشده‌اند. از این‌رو با توجه به قدمت قوانین مرتبط و عدم همخوانی آنها با تحولات و نیازهای امروز، ضروری است که اصلاحات و به‌روزرسانی در قوانین مرتبط و به‌طور اخص قانون جرایم رایانه‌ای صورت پذیرد.
