واکاوی نسبت (( زمان )) با (( احکام کیفری حدود ))

زمینه و هدف: احکام جزایی همانند دیگر احکام، منوط و مشروط به شرایط و ضوابط خاصی هستند. یکی از قیودی که بعضاً به مثابه سبب یا شرط احکام جزایی تشریع شده است، قید «زمان» است. این نوشتار با بررسی مصداقی شماری از احکام کیفری در پی پاسخ گویی به این سوال است که آیا اجرای احکام کیفری حدود با عنصری به نام «زمان» نسبتی دارد یا خیر؟ و در صورت وجود «نسبت»، کم و کیف این نسبت چگونه است؟روش: پژوهش حاضر به روش توصیفی و تحلیلی انجام شده است.یافته ها و نتایج: یافته ها و نتیجه به دست آمده این است که عنصر زمان با احکام کیفری نسبتی موثر دارد. این ارتباط در سه مرحله ارتکاب جرم، مرحله رسیدگی به جرم و مرحله مجازات و اجرای حکم، قابل مشاهده است و در هر یک از این مراحل موجب تغییر، اسقاط، تخفیف، تشدید، تاخیر و ... در احکام کیفری می‌شود. در مرحله اجرای کیفر حد فوریت زمانی و عدم تاخیر در اعمال مجازات به عنوان اصلی مهم در شرع مقدس اسلام مورد تاکید قرار گرفته است مگر آن‌که اجرای حکم مفسده‌ای به دنبال داشته و دلیلی موجه برای تاخیر در اجرا وجود داشته باشد.  در نحوه اجرای برخی مجازات‌های حدی  نیز عامل زمان موضوعیت داشته و رعایت آن شرعاً لازم است مانند ماندن مصلوب بر بالای دار به مدت سه روز یا مدت یک سال تبعید در مجازات برخی از جرائم مستوجب  حد می باشد.
