تحلیل حقوقی و تبیین ماهیت زیست بوم کشی (جنایت علیهِ محیطِ زیست)

زمینه و هدف: آسیب‌های زیست‌محیطی، امروزه جهان معاصر را با معضلات و پریشانی‌های عظیمی روبه‌رو کرده است. زیست‌بوم‌کشی به تخریب شدید، گسترده و طولانی‌مدت محیط‌زیست اطلاق می شود که به نتایج سهمگین و فاجعه‌باری همچون انقراض گونه‌های گیاهی، جانوری، مهاجرت اجباری و سلب یا کاهش لذت مسالمت‌آمیز زندگی ساکنان یک سرزمین منجر می‏گردد. هدف از این مقاله، تبیین ماهیت حقوقی زیست‌بوم‌کشی (جنایات علیه محیط‌زیست) است.روش‌شناسی: این مقاله با اتکا به اسناد و مدارک، و به شیوه تحلیلی-توصیفی نگارش یافته است.یافته‌ها و نتایج: بزه زیست‌بوم‌کشی مستلزم تحقق مجموعه‌ای از ارکان و عناصر اصلی و تبعی است. تخریب اعم از عمدی و غیرعمدیِ زیست‌بوم در قالب انهدام، احراق، ویرانی و آلودگی مهمترین رکن از ارکان زیست‌بوم‌کشی را تشکیل می دهد. علاوه بر رکن تخریب، ورود آسیب شدید، گسترده و طولانی‌مدت به محیط‌زیست که دارای پیامدهای بین‌المللی باشد، ارکان دیگر آن را تشکیل می دهند. در تحقق جرم، مکان اعم از خشکی و دریا و هوا، زمان اعم از جنگ و صلح و قربانیان جرم از نقش فرعی و غیراساسی برخوردارند.

Legal analysis and explanation of the nature of ecology (crime against the environment)

Field and Aims: Environmental damage has created tremendous problems and distress in the contemporary world. Ecocide is defined as severe, widespread and long- time destruction of the environment which will lead to disasterous and severe results such as plant and animal species extinction, compulsory emigration and lack or reduction of peaceful joy of the lives of the habitants of a land. This article is intended to explain the legal nature of ecocide (crimes against environment).Methodology: This article has been written based on documents and is of descriptive- analytical type.Findings and Conclusion: The crime of ecocide necessitates a study to be done by a group of main pillars and elements. Vandalism of the ecosystem, ranging from intentional or unintentional, in the forms of destruction, arsen, demolition and pollution comprises the most important pillars of ecocide. In addition to destruction, inflicting heavy, widespread and long-time damage on the environment which bear international ramifications comprises another pillar. In crime detection, a location, ranging from land, sea and air and time ranging from war and peace and crime victims bear major and minor roles in this regard.
