مطالعه تطبیقی بازرسی و تفتیش از اماکن در اجرای وظایف پلیس ایران و انگلستان

بازرسی و تفتیش از جمله اقدامات مهم و تاثیر گذاری است که در تحقیقات مقدماتی و یا تکمیلی توسط ضابطان دادگستری در جهت کشف جرم بعمل می‌آید این مسئله موجب گردیده است که وظایف و اختیاراتی بر عهده ضابطان دادگستری طبق قوانین و مقررات مدون قرار داده شود. موضوع مورد تحقیق با هدف مطالعه تطبیقی بین حقوق ایران و انگلیس در وظایف و اختیارات پلیس در بازرسی و تفتیش از اماکن انجام می‌گردد. ضابطان دادگستری در راستای کشف و حفظ آثار و ادله وقوع جرم و ادله شناسایی و دستگیری متهم و همچنین جلوگیری از فرار متهم و غیره گاه مجبور به استفاده از روش بازرسی و تفتیش می باشند با توجه به نقش و تاثیر این روش در کشف و پیشگیری از جرم و همچنین ضابطان دادگستری به اقتضای ماموریت های محوله به خود (ایجاد و حفظ نظم و امنیت) تمایل دارند که از اختیارات گسترده‌ای برخوردار باشند لیکن نهادهای قانونگذار، حقوقدانان، قضات و وکلاء با تاکید بر رعایت و احترام به حقوق شهروندی با این امر مخالفت می‌نمایند. موضوع بازرسی و تفتیش از اماکن در بیشتر مواقع در خصوص مظنونین و متهمین به ارتکاب جرم انجام می‌شود بایستی عنایت داشت که این امر به گونه‌ای صورت پذیرد که حقوق افراد مظنون و متهم نیز بصورت متعادل و متوازن مورد حمایت و رعایت قرار گیرد زیرا که نادیده گرفتن این حقوق موجب عدم رعایت انصاف، عدالت و قانون خواهد بود.

Adaptive Study of Inspection and Search of Places in Executing Iran and England’ Police Duties

Inspection and search are considered as important and impressive measures that are conducted in preliminary or supplementary investigations by Judiciary agents in detecting crimes. This issue has put duties and authorities upon the Judiciary agents in line with codified laws and regulations. The issue under research is carried out with the aim of adaptive study of Iran and England’s laws in duties and authorities of police in inspecting and searching places. The Judiciary agents along with detecting and safeguarding evidence and traces of crime perpetration and evidence of identifying and arresting the accused and preventing the accused from running away and the like, as well, are obliged to use inspection and search method. In regards to the role and impact of this method in detecting and preventing crimes and considering the fact that the Judiciary agents are usually willing to have vast authorities in their assigned tasks (restoring order and security), as well, but legislative agencies, lawyers, judges and attorneys disagree with this issue emphasizing civil liberties and rights. The issue of inspection and search of places are frequently carried out particularly against suspects and the accused. It should be noted that this issue be carried out in a manner that the rights of the suspects and accused be proportionally and moderately protected and observed because ignoring this right will cause lack of fairness, justice and law.
