جرایم زیست محیطی سازمان یافته با تاکید برحقوق فرانسه

جرایم علیه محیط زیست و عدم توجه کافی به آن به یکی از معضل های جوامع انسانی در مواجهه با طبیعت تبدیل شده است. از نیمة دوم قرن بیستم، مسئلة محیط زیست جنبة جهانی به خود گرفت و به یک بحران پایدارِ جامعة بین المللی تبدیل شد؛ بحرانی که همة ساکنان زمین را تهدید جدّی نموده و امروزه نیز با شدّت گرفتن مسئلة گرمایش جهانی و بحران تغییرات اقلیمی، ابعاد تازه ای به خود گرفته است؛ بحرانی که میرود تغییرات اجتماعیِ عظیمی را در زندگی بشر، آن نیز به اجبار، ایجاد نماید؛ بحرانی که منابع حیاتی زمین را نیز در معرض خطر جدّی قرار داده است. برای مقابله با این بحران تقویت سیاست جنایی و زرادخانه کیفری کشورها و جامعه بین المللی علیه جرایم محیط زیستی به ویژه نوع سازمان یافته آن ضروری به نظر می رسد. از اواخر دهه 1990 دولتها با توسل به حقوق کیفری درصدد حل این معضل برآمدند اما ماهیت خاص این جرایم که از سود بالا و خطر کمی برخوردار می باشند باعث شد توسل به حقوق کیفری نتواند کاهش قابل توجهی در نرخ این جرایم - بخصوص در کشورهای در حال توسعه ایجاد کند. با محوریت این امر، نوشتار حاضر در صدد بررسی آن است که چرا این جرم به شکل سازمان یافته به شدت در حال گسترش است. نوشتار حاضر با رویکردی توصیفی-تحلیلی با تطبیق واقعیات موضوعی پیش رفته و در نهایت پس از تحلیل موضوع نتیجه گیری می نماید که جرایم زیست محیطی عمدتا به دلیل عدم تناسب کیفر و ناکافی بودن ابزارهای قانونی در سطح ملی و بین المللی، رو به افزایش است، از این رو؛ لازم است راه حل هایی برای بهبود حمایت کیفری از محیط زیست مورد توجه قرار گیرد.

Organized Environmental Crimes with an Emphasis on France’s Law   Abstract Crimes against environment and insufficient attention to it have turned into one of the concerns of human societies in facing nature. Since mid21 century, the issue of environment gained global attention and turned into a sustainable crisis of the international society, a crisis that has seriously threatened all the residents of the Earth, and while global warming is escalating today and climate change crisis has also gotten new dimensions, this crisis is going to force grand social changes, a crisis that has put vital resources of the Earth at risk. To combat this kind of crisis, it seems that improving criminal policy and criminal arsenal of countries and the international community is necessary. Since late 1990s, governments tried to resolve this issue by resorting to criminal laws but the special nature of these crimes that benefit from high gains and low risks caused the resorting to criminal Laws unable to reduce these crime rates considerably, particularly in developing countries. Centering on this, the present article has attempted to find causes of tremendous escalation of this organized crime. The present article has progressed with a descriptiveanalytical approach by adapting the subject facts and finally by analyzing the issue, concludes that the environmental crimes are escalating primarily due to lack of proportionality of punishment and insufficiency of legal tools in national and international levels. Therefore; it is necessary that certain solutions be taken into considerations in order to improve criminal support of the environment.
