آثار نقض وفاداری زوجین در خانواده و ضمانت اجرای حقوقی و کیفری آن

دو نهاد خانواده و اجتماع بر یکدیگر تاثیر متقابل دارند و زوال و بقای هریک در دیگری اثرگذار است. یکی از عوامل پایداری خانواده، وفاداری زوجین است و نقض آن به بنیان خانواده لطمه وارد می‌کند. لذا در این مقاله به بررسی و تبیین مسئله نقض وفاداری زوجین و ضمانت اجراهای حقوقی و کیفری آن ‌در نظام‌ حقوقی ‌ایران پرداخته ‌شده است. روش ‌پژوهش حاضر، ‌توصیفی و تحلیلی است. برای گردآوری اطلاعات نیز از روش کتابخانه‌ای با استفاده از راهبردها و ابزارهای متنوعی ازجمله اسناد، کتب، مقالات، سایت‌های اینترنتی، متون ‌چاپی‌ نمایه ‌شده در بانک‌های‌ اطلاعاتی و دیگر منابع مرتبط موجود در کتابخانه‌های عمومی، تخصصی یا دیجیتال بهره گرفته شده است. یافته‌های تحقیق نشان می دهد نقض وفاداری در قالب سه دیدگاه قابل ‌بررسی‌ است و نظری که ترجیح دارد این است که زوجین از برقراری رابطه نامشروع با دیگران خودداری کنند. ضمانت اجرای نقض وفاداری زوجین در دو قالب مسئولیت مدنی و کیفری است. مسئولیت مدنی شامل مطالبة خسارت مادی و معنوی از جانب شخص ‌زیان‌دیده و طلاق است. چند ‌روش برای مطالبۀ طلاق وجود دارد. طلاقی که از سوء معاشرت زوج ناشی شده است، یک طلاق قضایی و از نوع بائن است. مسئولیت‌ کیفری هم در صورت اثبات جرم، مجازات رابطه نامشروع را دارد و همچنین می‌تواند شامل حد مربوطه باشد. اگرچه شاید تصور شود مسئولیت ‌شخص یک مسئولیت ‌قراردادی صرف است ولیکن این‌چنین نیست؛ زیرا نکاح قرارداد خصوصی نیست و آثاری دارد که به طرفین تحمیل می‌شود. قرارداد نکاح با نظم عمومی مرتبط است و باید قواعد آمره آن‌ از جانب زوجین رعایت شود. در حقوق کشور ما، رابطه نامشروع زوجین با دیگران از جرائم عمومی است، البته اگر ضمن عقد نکاح شرط ‌شده باشد که در صورت سوء معاشرت، همسر حق طلاق دارد، از باب مسئولیت ‌قراردادی است.

Effects of Civil and Criminal Breach of Spouses’ Loyalty on Family, and Its Legal and Penal Enforcement

Family and community have interactions both with each other and affect one another in decline and survival. One of the elements of families’ stability is couples loyalty and its breach hurts the family. Therefore, this article is to review and explain the issue of breach of loyalty in spouses and its legal and penal enforcement in Iran’s legal system. The study is conducted via a descriptive and analytical method. To collect information within a library research, variety of instruments and strategies, including documents, books, articles, online websites, and other related resources available in public and specialized libraries and data bases, have been utilized. The findings indicate that a breach of loyalty can be studied in three perspectives and the preferred view is that couples refuse having illegal relationship with others. Enforcement of spouses’ breach of loyalty is the form of civil and criminal liability. Civil liability includes material and intellectual damages claimed from the injured party and divorce. There are several methods for seeking divorce. The divorce resulted from illegal relationship is a judicial divorce and the type is irrevocable. Criminal liability if found guilty, has the punishment of illegitimate relationship. Although it may be thought that person responsibility is a mere contractual liability, but this is not the case, because the marriage contract is not private and it has imposed works upon the parties. A marriage contract is related to public order and its peremptory rules should be observed by the couple. In our country's legal system, illegal relationship with others is considered as a public offense and if the marriage contract stipulated that a couple has the right to divorce, it is contractual from the responsibility perspective.
