موانع مشارکت خانواده در پاسخ دهی به بزه اطفال و نوجوانان

زمینه و هدف: نظرات متعدد جرم شناسی با پذیرش کارکردهای منحصر بفرد خانواده و تاثیر آن بر بزهکاری فرزندان، به لحاظ تئوریک این موضوع را به اثبات می‌رساند که اگر نظام قضایی در فرایند پاسخدهی به بزه از مشارکت خانواده بهره‌مند شود؛ واکنش مناسب‎تری به بزه اطفال و نوجوانان ارائه می‌شود. لیکن پیاده سازی این ایده در عمل با موانعی روبرو خواهد شد و تنظیم سیاست جنایی متناسب بدون ملاحظه این مسائل امکان‌پذیر نیست. هدف این پژوهش یافتن موانعی است که خانواده در مقام ایفای نقش موثر با آن روبرو خواهد شد.روش: پژوهش پیش‌رو در زمره پژوهش‌های توصیفی-تحلیلی است. نگارنده بر آن است که با تجزیه‌و‌تحلیل اطلاعات حاصل از بررسی منابع کتابخانه‌ای، موانع مشارکت خانواده در پاسخدهی به بزه اطفال و نوجوانان را بیاید و به پیشنهاداتی اشاره نماید که زمینه بهبود سیاست جنایی را فراهم می‌سازد.یافته‌ها: گاهی خانواده‌ها به دلایلی نظیر ترس از قضاوت نادرست و بی‌اعتمادی به نظام قضایی تمایلی به مشارکت با مقام قضایی ندارند. عدم اطلاع از فرایند رسیدگی و نحوه مشارکت موثر، ناکارآمدی در ایفای نقش موثر، مشکلات تعاملی میان والدین و فرزند بزهکار و هم‌چنین محدودیت امکانات اجرایی خانواده، از دیگر مسایلی هستند که مانع مشارکت موثر خانواده خواهد شد. توجه به این محدودیت‌ها در فرایند اصلاح قوانین و مقررات، تمهید زیرساخت‌های مناسب و تخصیص امکانات مورد نیاز (منابع انسانی آموزش دیده و متخصص، بودجه و حمایت‌های اجتماعی مورد نیاز) امری ضروری است.

background and purpose: numerous criminological views, by accepting the unique functions of the family and its impact on children's delinquency, theoretically prove that if the judicial system benefits from family participation in the process of responding to crime, a more appropriate response to child and juvenile crime will be provided. however, the implementation of this idea will face obstacles, and it is not possible to formulate a suitable criminal policy without considering these issues. the aim of this research is to find the obstacles that the family will face in playing an effective role.method: the present study is a descriptive-analytical study. the author aims to analyze the information obtained from the review of library resources, identify the obstacles to family participation in responding to child and juvenile crime, and point out suggestions that will pave the way for improving criminal policy.findings: sometimes families are reluctant to participate with the judicial authorities for reasons like fear of wrongful judgment and distrust of the judicial system. lack of knowledge about the process of investigation and how to participate effectively, inefficiency in playing an effective role, interaction problems between parents and children, as well as limited administrative facilities to participate in meetings and fulfill obligations, are other issues that will prevent effective participation of the family. it is essential to pay attention to these limitations in the process of amending laws and regulations, providing appropriate infrastructure, and allocating the necessary facilities (trained and specialized human resources, budget, and necessary social support).
