سیاست‌جنایی ایران در قبال پدیده ازدواج‌سفید؛ از جرم‌انگاری تا پاسخ‌گذاری

زمینه و هدف: ازدواج‌سفید، ازدواجی است که در آن مرد و زن به‌صورت غیررسمی و بدون عقد شرعی با یکدیگر زندگی می‌کنند. این پدیده، در سال‌های اخیر در ایران در حال رشد است. این مطالعه باهدف شناسایی خلاهای قانونی و تبیین سیاست‌جنایی جرم‌انگاری ازدواج‌سفید و پاسخ‌گذاری مناسب به این پدیده اجتماعی انجام شد.روش: پژوهش حاضر از نظر هدف کاربردی و از نظر شیوه اجرا در زمره پژوهش‌های کیفی است که میدان پژوهش، قوانین کیفری و مدنی و نیز سوابق پژوهشی در حوزه سیاست‌جنایی و ازدواج سفیده بوده و داده‌های آن با استفاده از ابزار فیش‌برداری از منابع و اسناد کتابخانه‌ای جمع‌آوری و به روش تحلیل محتوا مورد تجزیه‌وتحلیل قرارگرفته است. برای اعتبارسنجی داده‌ها از راهبرد کنترل و بازبینی بیرونی استفاده شد.یافته‌ها و نتایج: پژوهش نشان داد برای سیاست‌گذاری جنایی در حوزه ازدواج‌سفید، دو اقدام جرم‌انگاری و پاسخ‌گذاری ضروری است. در بخش جرم‌انگاری، رابطه نامشروع و زنا، عدم ثبت واقعه ازدواج، ترک نفقه، سقط‌جنین غیرقانونی قابل‌بازنگری و مقرره‌گذاری مجدد است و در بخش پاسخ‌گذاری نیز اقدامات کنشی (غیرقهری) در قالب پیشگیری اجتماعی و اقدامات واکنشی (قهری) در قالب اصلاح و تادیب و کیفر مرتکب قابل‌اعمال است.

iran's criminal policy regarding the phenomenon of white marriage; from criminalization to response

background and aim: a white marriage is a marriage in which a man and a woman live together informally and without a religious contract. this phenomenon is growing in iran in recent years. this study was conducted with the aim of identifying legal loopholes and explaining the criminal policy of criminalizing white marriage and providing an appropriate response to this social phenomenon.method: the present research is qualitative research with a practical purpose in the field of criminal and civil laws, as well as research records in the field of criminal politics and white marriage, and its data is obtained by using the tool of extracting files from library sources and documents. collected and analyzed by content analysis method. external control and review strategy was used to validate the data.results and conclusion: the research showed that for criminal policy in the field of white marriage, two measures of criminalization and response are necessary. in the criminalization section, illicit relationship and adultery, non-registration of marriage, abandonment of alimony, illegal abortion can be reviewed and re-regulated, and in the response section, active (non-coercive) measures in the form of social prevention and reactive (coercive) measures in the form of correction and discipline and punishment is applicable.
