مبانی سیاست‌گذاری تقنینی حضور پلیس زن مبتنی بر تحقق بند 134 منشور حقوق و ﻣﺴﺌﻮﻟﯿﺖ ﻫﺎی زﻧﺎن در ﺟﻤﻬﻮری اﺳﻼﻣﯽ اﯾﺮان

بند 134 منشور حقوق و مسئولیت‌های زنان در نظام جمهوری اسلامی ایران «حق دسترسی زنان به نیروی انتظامی و ضابطین دادگستری زن در صورت تعرض، بزه دیدگی، اتهام و ارتکاب جرم» را به عنوان یکی از حقوق زنان و از جمله مسئولیت‌های قضایی نیروی انتظامی و ضابطان دادگستری زن محسوب می‌نماید. در این مقاله مبانی سیاست‌گذاری تقنینی حضور ضابطان زن و اقدامات نیروی انتظامی مبتنی بر تحقق بند 134 منشور بررسی شده است.روش: پژوهش حاضر، از دسته پژوهش‌های کاربردی محسوب شده و با روش توصیفی - تحلیلی و با استفاده از منابع کتابخانه‌ای انجام شد. جامعه آماری اسناد مرتبط با ضابطان زن و حقوق زنان بزهکار و بزه‌دیده در مواجهه با آنهاست.یافته‌ها: بر اساس دستور العمل خدمتی کارکنان زن انتظامی، زنان در ناجا در مشاغل راهور، انتظامی، اطلاعات، آگاهی، مراکز مشاوره کلانتری‌ها، مراکز آموزشی و فرهنگی، سازمانهای عقیدتی سیاسی و حفاظت اطلاعات بکارگیری می‌شوند که در این مقاله ماموریت‌های پلیس زن مرتبط با ماده 134 منشور مورد بررسی قرار گرفته است.نتیجه‌گیری: نیروی انتظامی هم راستا با اسناد فرادستی و منشور حقوق و مسئولیت‌های زنان اقدام به سیاستگذاری و اصلاح قانون استخدام و جذب زنان در مشاغل انتظامی نمود و با بکارگیری زنان به عنوان ضابط دادگستری، رعایت موازین شرعی و حفظ کرامت انسانی زنان را به عنوان یکی از اصول ارزشی خود معرفی و با تدوین دستورالعمل خدمتی پلیس زن و به کارگیری آنان در مشاغل انتظامی، آگاهی و مشاوره کلانتری ها، قواعد و اصول مندرج در این منشور را اجرایی نموده است.

Principles of Legislative Policy-Making for the Presence of Female officers and the actions of the police force based on the implementation of Article 134 of the Charter

article 134 of the women’s rights and responsibilities charter in the Islamic republic of Iran, considers “the right of women to have access to female law enforcement authority and police officers in the case of molestation, victimization, accusation and malfeasance” as one of their basic rights and a responsibility of police and law enforcement authorities. According to article 134 of the charter, this paper explores the legislative policy-making fundamentals for female officer presence as well as the requirements that should be carried out by the law enforcement authority.This is a qualitative documentary research. Moreover, the library-documentary approach is also utilized to gather the required data through the taking notes. The statistical population includes those documents that are related to female officers as well as the rights of criminal women and victims.In police force of Islamic Republic of Iran (NAJA), Women’s are mainly employed in some important fields such as law enforcement, traffic police, information, police criminal investigation, educational and cultural centers, police ideological−political advisory centers of police station, and intelligence protection organization. The current research investigates the critical missions of female police officers according to Article 134 of the Charter.observance of religious criteria and preserving women’s human dignity are defined by utilizing women as judicial officers, as one the value principles by law enforcement force. Besides, in this charter, the law enforcement force executed some critical rules and principles by the codification service guidelines for female police and planning.
