تعارضات و تشابهات حقوق بشر اسلامی با حقوق بشر جهانی با تاکید بر حقوق زنان در ایران

هدف: پژوهش حاضر با هدف بررسی تعارضات و تشابهات موجود میان حقوق بشر اسلامی با حقوق بشر جهانی در حوزه حقوق زنان، در صدد پاسخگویی به این سوال است که چه تعارضاتی و تشابهاتی میان حقوق بشر اسلامی با حقوق بشر جهانی در حوزه حقوق زنان در ایران به چشم می‌خورد.روش: این پژوهش، به لحاظ چارچوب پژوهشی و ماهیت داده، در زمره تحقیقات کیفی و به لحاظ بررسی خصوصیات موضوع و مسئله، پژوهشی توصیفی- تحلیلی قلمداد می شود و برای احرا، از روش اسنادی در آن استفاده شده است. جامعه هدف یا متون مورد بررسی در این پژوهش، توصیه نامه هایی است که ایران طی دوره اول و دوم بررسی پرونده حقوق بشر خود در شورای حقوق بشر، دریافت نموده است. از 511 توصیه ای که ایران در دو دوره بررسی جهانی پرونده حقوق بشر خود دریافت نموده است، در مجموع حدود یک سوم توصیه نامه ها (152 مورد) پیرامون حقوق زنان است که تمامی این متون مورد بررسی قرار گرفته است. اعتبار و پایایی این پژوهش با در نظر گرفتن چارچوب مفهومی موضوع، با دستیابی به کفایت نظری حاصل شد.یافته ها و نتایج: علی رغم تشابهات و تطابق های که میان حقوق بشر اسلامی و حقوق بشر جهانی پیرامون حقوق زنان وجود دارد، اما در حوزه های حقوق فردی، حقوق خانوادگی، حقوق اجتماعی، حقوق فرهنگی و معنوی زنان، حقوق اقتصادی، حقوق سیاسی و نیز در حوزه حقوقی و قضایی، تعارضاتی میان حقوق بشر اسلامی با حقوق بشر جهانی وجود دارد. این تعارضات در عمل عدم پذیرش و الحاق به برخی کنوانسیون های حقوق بشری در حوزه زنان را برای ایران در پی داشته و زمینه ساز طرح اتهامات حقوق بشری از سوی غرب بر علیه ایران و تلقی از این کشوذ به عنوان «ناقض حقوق زنان» شده است.

Conflicts and similarities between Islamic human rights and international human rights with emphasis on women’s rights in Iran

Objective: The aim of this study is to investigate the existing conflicts between Islamic human rights and universal human rights in the field of women’s rights?Method: Using a qualitative method based on collecting information from library sources (documentary) and descriptive analytical method, the present article seeks to assess the hypothesis presented in this research.Findings: In areas such as individual rights (right of citizenship, right to residence and housing), family rights (age of marriage, freedom to choose and polygamy, right of guardianship over the spouse, right Divorce and custody of the child), social rights (right to insurance and social security benefits and the right to health services), Women’s cultural and spiritual rights (right to literacy based on coeducation and restrictions on sending female students abroad), economic rights (right to work in certain occupations and also right to inheritance), political rights (right to be elected to some key positions in the country) Such as leadership and presidency) as well as in the legal and judicial spheres (women’s right to legal personality, equality before the law and some women’s civil and criminal rights such as blood money and martyrdom) conflicts between Islamic human rights and human rights The world is visible.Results: In addition to legal conflicts, differences in interpretations and the existence of some legal ambiguities between the two sources of Islamic and international human rights can be seen, which in practice leads to nonacceptance and accession to some human rights conventions in the field of women for Iran.
