مطالعه بزه دیده شناسی آبی در حقوق ایران و اسناد بین الملل با تاکید بر حمایت پلیسی از زنان و کودکان

زمینه و هدف : اصطلاح بزه دیده شناسی آبی مطالعۀ قواعد، مقررات و در واقع، هنجارهای بین المللی است که با محوریت اسناد سازمان ملل متحد در زمینۀ مسائل بزه‌دیده‌ شناختی مربوط به زنان به تصویب رسیده است. هدف این تحقیق، شناسایی بزه دیده شناسی آبی از دیدگاه حمایت از زنان بزه دیده در سطح مقررات بین المللی و نیز شناسایی بسترها و ظرفیت های حقوق داخلی ایران دراین زمینه می باشد. روش شناسی تحقیق : این تحقیق از نوع کیفی بوده که به روش توصیفی تحلیلی و با تکیه بر اسناد بین المللی و مطالعه قوانین و مقررات ملی به صورت اسنادی و کتابخانه ای انجام گرفته است.یافته های تحقیق : هرچند قوانین وضع شده در سطح بین المللی در جهت حمایت از زنان در جامعه جهانی از ضمانت اجرای کافی برخوردار نیست اما در نظام کیفری ایران، به خصوص در بعد تقنینی، اقدامات گسترده ای در خصوص حمایت از زنان هم سو با اقدامات بین المللی صورت گرفته است.نتیجه گیری : بزه دیده شناسی آبی در سطوح قضایی و اجرایی در ایران در مقایسه با معیارهای بین المللی بزه دیده شناسی آبی نوپا محسوب شده که با اقداماتی از جمله مداخله های اجتماع محور و مداخلات بهداشتِ روان و جلوگیری از بزه دیدگی مضاعف، با تصمیمات مقتدرانه در سطوح قضایی و نیز اجرایی کردن قوانین بین المللی از جمله ترویج کمک های چند جانبه و همکاری دولت ها به منظور تبادل اطلاعات و جرم یابی سریع می تواند گام های اساسی در این زمینه بپیماید.

The status of women’s protection in the Iranian penal system from the perspective of blue victimology and international documents.

Background and Aim: The term blue victimology is the study of international rules, regulations and, in fact, international norms focusing on UN documents on criminological and cognitive victim issues related to women (such as delinquency, victimization and prevention). Research Methodology: This research is a qualitative type that has been done in a descriptiveanalytical method, relying on international documents and studying national laws and regulations in the form of documents and libraries. Findings: The norms contained in the UN Human Rights Documents on the Prohibition of Violence against Women and the Protection of the Rights of Children and Adolescents can be considered as measures taken in the field of blue victimology to protect women victims and children internationally and In domestic law, we can also refer to legislative norms and actions of civil institutions. in the Iranian penal system, especially in the legislative dimension, extensive measures have been taken to protect women in line with international action. Conclusion: blue victimology at the judicial and executive levels in Iran in comparison with international standards is considered a nascent blue victimology that with measures such as communitybased interventions and mental health interventions and prevention of double victimization, with authoritative decisions At the judicial level, as well as the implementation of international law, including the promotion of multilateral assistance and cooperation between governments in order to exchange information and expedite criminalization, fundamental steps can be taken in this regard.
