a new perspective at comprehensiveness of islamic education theory with regard to concept of silence in jurisprudential and legal sources

The changes of the last half century in the world, influenced by new technologies, have posed new issues and challenges to religious and educational systems. in this situation, in iran “educational jurisprudence” emphasizes the theory ofcomprehensiveness of islamic education& through extending the theory ofcomprehensiveness of islam& to the field of education. the purpose of this study is to critique the “comprehensiveness of islamic education theory” with regard to the concept of silence in jurisprudential and legal sources. while the method of study is comparative, library method and conceptual-religious method were used to collect and analyze data respectively. the research findings showed that although there are differences between jurists regarding the theory of the shari’a silence in jurisprudence, but the proposition ofaccepting the silence of shari’a relatively& by some jurists which is an intermediate view can indicate the rejection of comprehensiveness of islamic education theory. also, the findings indicate that the main discussion of the jurists is about possibility of stabilizing or changing the decrees that already existed, and there has been less discussion about new issues of contemporary world for which there is no previous islamic rules. in a general conclusion, it can be said that acceptance of comprehensiveness of islam does not necessarily mean the comprehensiveness of islamic education and denying this comprehensiveness can reduce the heavy responsibility of those who believe in this theory.

نگاهی دوباره به نظریه جامعیت تربیت اسلامی با توجه به مفهوم سکوت در منابع فقهی و قانونی

تحولات نیم قرن اخیر دنیا متاثر از فناوری های نوین ، موضوعات و چالش های جدیدی پیش روی نظام های مذهبی و آموزشی قرار داده است. در این وضعیت در ایران ، فقه تربیتی با تعمیم تئوریجامعیت دین اسلام& به حوزه تعلیم وتربیت به نظریهجامعیت تربیت اسلامی& تاکید می ورزد. هدف پژوهش حاضر نقد نظریه جامعیت تربیت اسلامی با توجه به مفهوم سکوت در منابع فقهی و قانونی است. در حالی که روش تحقیق حاضر ، تطبیقی کیفی است برای جمع آوری داده ها از روش کتابخانه ای و برای تحلیل داده ها از روش مفهومی دینی با رویکرد تربیتی استفاده گردید. یافته های تحقیق نشان داد اگرچه نسبت به نظریه سکوت شارع در فقه، اختلافاتی بین فقها به چشم می خورد ولی طرح دیدگاهپذیرش سکوت شرع به نحو نسبی& توسط بعضی از فقها که دیدگاهی بینابینی است می تواند نشانگر نفی نظریه جامعیت تربیت اسلامی باشد. هم چنین یافته ها نشانگر آن است که بحث اصلی فقها عمدتا در خصوص امکان ثبات یا تغییر احکامی است که قبلا وجود داشته اند و کمتر گفت وگویی بین آنان در خصوص موضوعات جدیدی که برای آن هیچ حکم قبلی وجود ندارد ، صورت گرفته است. در یک جمع بندی کلی می توان گفت پذیرش جامعیت دین اسلام لزوما به معنای جامعیت تربیت اسلامی& نیست و نفی این جامعیت از مسئولیت سنگین معتقدان به آن می کاهد.
