A Comparative Study of the Educational Rights of Foreign Citizens in the Legal System of Iran and France

From last four decades, the middle east region has witnessed escalation of political and religious conflicts, wars and migration of millions of people to other countries. while the rights of foreign nationals are enshrined in all international memoranda of understanding and accepted by most countries around the world, the purpose of this paper is to compare the educational rights of foreign nationals in the iranian and french legal systems.the method of research is comparative and selection of countries is based on targeted sampling. the structured search method was used to collect data and the data analysis method was directed content analysis. the research findings show that there are similarities between the french and iran legal systems in terms of accepting international treaties - in which the educational rights of foreign nationals are clearly recognized. the main differences between these legal systems are the lack of a clear law on the practical implementation of the educational rights of foreign nationals for about forty years, the multiplicity of law enforcement centers for foreign nationals and lack of attention to role of mothers in issuing birth certificates for children in iran and lack of clarity of educational laws relating to foreign nationals in france. based on research findings, iranian legislators are encouraged to review the laws related to the educational rights of foreign nationals, given the need to harmonize laws with the new developments in societies, as well as international law.

بررسی تطبیقی حقوق آموزشی اتباع بیگانه در نظام حقوقی ایران و فرانسه

حقوق اتباع بیگانه در همه  تفاهم نامه های بین المللی مورد تاکید و توسط اکثر کشورهای جهان پذیرفته شده است. لیکن این حقوق در منطقه خاورمیانه در چهار دهه اخیر به دلیل اوج گیری تعارضات سیاسی و مذهبی ، جنگ ها و مهاجرت میلیون ها نفر به کشورهای دیگر با چالش هایی روبرو بوده است ،  هدف مقاله حاضر بررسی تطبیقی حقوق آموزشی اتباع بیگانه در نظام حقوقی ایران و فرانسه است. روش تحقیق ، تطبیقی کیفی و انتخاب کشورهای مورد مطالعه بر اساس نمونه گیری هدفمند صورت پذیرفت. برای جمع آوری داده ها از روش جستجوی ساختار یافته استفاده و روش تحلیل داده ها آنالیـز محتـوی کیفـی هدایـت شـده بود. یافته های تحقیق نشان می دهند بین نظام های حقوقی فرانسه و ایران از لحاظ پذیرش میثاق های  بین المللی که در آنها حقوق آموزشی اتباع بیگانه بوضوح به رسمیت شناخته شده است شباهت وجود دارد. عمده ترین تفاوت ها بین این دونظام حقوقی به مواردی همچون عدم تصریح قانون گذار بر اجرای عملی حقوق آموزشی اتباع بیگانه برای حدود چهل سال درایران ، تعدد مراکز صدور قانون برای اتباع بیگانه در ایران ، عدم توجه به نقش مادر در صدور شناسنامه برای کودکان در ایران و عدم وضوح قوانین آموزشی مرتبط با اتباع بیگانه در فرانسه اشاره دارد . بر اساس یافته های تحقیق به قانون گذاران ایرانی پیشنهاد می گردد با توجه به لزوم هماهنگی قوانین با تحولات جدید جوامع و هم چنین تصریح قوانین بین المللی، در قوانین مرتبط با حقوق آموزشی اتباع بیگانه بازنگری صورت پذیرد.
