تضمین حقوق شهروندی در پرتو ظرفیت‌های فقه اسلام و حقوق موضوعه ایران با تاکید بر امنیت اجتماعی

زمینه و هدف:  اجتماعی بودن حیاتِ انسان‌ها، باعث ایجاد مصالح و منافعی مانند «حقوق شهروندی» و «امنیت اجتماعی» شده که می‌باید بر اساس ارزش‌های مورد احترام جامعه و دستیابی به عدالت، تامین و تضمین گردند. هدف پژوهش حاضر بررسی ظرفیت‌های فقه اسلام و حقوق موضوعه ایران در تضمین حقوق شهروندی افراد جامعه است.روش: رویکرد مقاله حاضر توصیفی – تحلیلی؛ روش جمع‌آوری اطلاعات، به صورت کتابخانه‌ای و تجزیه و تحلیل داده ها نیز با استفاده از سه گام شناسایی، توصیف، استنباط و استنتاج انجام شده است. در این روش با استناد به منابع مورد استفاده و پس از توضیح نظام‌مند و دقیق موضوع، استنتاج ذهنی به عمل می‌آید و سبب نتایج عینی از تحلیل محتوا حاصل می گردد.یافته‌ها: مطابق یافته‌های پژوهش باید گفت تضمین حقوق شهروندی از منظر فقه اسلام، از رهگذر«کرامت مداری»، «عدالت‌محوری»، «توجه جدی به امنیت روانی جامعه»، «سیاست‌های کیفری در فقه»، «دستورهای اخلاقی و احکام فقهی غیر الزامی» محقق خواهد شد. همچنین یافته های مربوط به حقوق موضوعه ایران نیز عبارتند از: «تلاش برای تحول در سیاست‌های تقنینی»، «تلاش برای تحول در سیاست‌های قضایی»، «تضمین حقوق شهروندی در آراء و نظرات شورای نگهبان»، «تضمین حقوق شهروندی در شوراهای اسلامی شهر و روستا»، «تضمین حقوق شهروندی توسط دیوان عدالت اداری»، «تلاش برای ایجاد، تسری و نهادسازی گفتمان تکالیف شهروندی در جامعه».نتایج: نتایج تحقیق حاکی از آن است که تضمین حقوق شهروندی در جامعه نیازمند رویکردی همه جانبه و چندوجهی است و بهره‌گیری از ظرفیت‌های مترقی فقه امامیه و حقوق موضوعه ایران که در پژوهش حاضر بررسی و تبیین شد، می‌تواند به حل مسئله مطرح شده کمک  نماید.

guaranteeing citizenship rights in the light of the capacities of islamic jurisprudence and iran’s subject law with an emphasis on social security

abstractbackground and purpose: the social nature of human life has created benefits and interests such as citizenship rights and social security which need to be provided and guaranteed based on the values ​​respected by the society and in order to achieve justice. the purpose of the current research is to investigate the capabilities of islamic jurisprudence and iran’s subject law in guaranteeing the citizenship rights of people in the society.methodology: the approach of the current article is descriptive-analytical and the method of collecting information is in the form of a library, and the analysis of data has been done using three steps: identification, description, and inference. in this method, based on the used sources and after a systematic and detailed explanation of the subject, mental inference was made and objective results were obtained from the content analysis. then, the obtained data was reviewed and confirmed by an expert panel consisting of 5 professors specializing in jurisprudence and legal fields.findings: according to the findings, the guarantee of citizenship rights from the point of view of islamic jurisprudence will be realized through dignity-oriented, justice-oriented, serious attention to the psychological security of society, criminal policies in jurisprudence, moral orders and non-mandatory jurisprudence. also, the findings related to iran’s subject rights include efforts to transform legislative policies, efforts to transform judicial policies, guaranteeing citizenship rights in the votes and opinions of the guardian council, guaranteeing citizenship rights in islamic city and village councils, guaranteeing citizenship rights by the court of justice. administrative, trying to create, spread and institutionalize the discourse of citizenship duties in the society.results: the results of the research indicate that guaranteeing citizenship rights in the society requires an all-round and multifaceted approach with greater coordination between the custodian institutions and the people. it is obvious that in this context, taking advantage of the progressive capacities of islamic jurisprudence and the subject laws of iran, which have been examined and explained in the present research, can help to solve the problem in question.
