مقابله با نارکوتروریسم در حقوق بین الملل

ارتباطات گوناگونی میان سازمان‌های تروریستی و گروه‌های مجرمانه وجود دارد. در میان جرایم سازمان یافته، مشارکت گروه‌های تروریستی در قاچاق موادمخدر به طور فزاینده ای گسترش یافته است. نارکوتروریسم یا تروریسم مرتبط با موادمخدر جلوه ای بارز از پیوند میان تروریسم و جرایم سازمان یافته فراملی است که در دو مفهوم اصلی نمایان شده است: مشارکت مستقیم تروریست ‌ها در تجارت موادمخدر برای تامین مالی فعالیت‌های خود و نیز استفاده از روش‌های تروریستی از جانب سازمان‌های قاچاق موادمخدر برای تسهیل تجارت موادمخدر. اگرچه ارتباط و تعامل بین این دو پدیده به صورت جهانی مورد شناسایی قرار گرفته است اما اشکال و ماهیت این تعامل به علت مبهم و پیچیده بودن آن، همواره موردبحث بوده است. هدف از این پژوهش، واکاوی ترکیب تروریسم و قاچاق موادمخدر در یک پدیده واحد به نام نارکوتروریسم است و نیز ارائه پاسخ به این مسئله که چه پیوندی میان این دو تهدید جهانی وجود دارد و از منظر حقوق بین الملل، چه اقداماتی در راستای مبارزه با این پیوند صورت گرفته است. یافته های این پژوهش نشان می دهد که قاچاق موادمخدر به مهم‌ترین منبع تامین مالی گروه‌های تروریستی در جهان بدل گردیده است و تا زمانی که عرضه و تقاضای گسترده موادمخدر در مقیاس جهانی وجود دارد، مبارزه با تهدیدهای نارکوتروریستی با موفقیت همراه نخواهد بود. علاوه براین، خلا وجود یک سند حقوقی جامع و الزام آور جهانی، مقابله با نارکوتروریسم را با مشکلاتی مواجه ساخته است. پژوهش حاضر از منظر ماهیت و روش، توصیفی تحلیلی و از نظر نوع، بنیادی است و اطلاعات مندرج در پژوهش نیز به روش کتابخانه ای گردآوری شده است.

Counter-narcotics in international law

There are various connections between terrorist organizations and criminal groups. Among organized crime, the involvement of terrorist groups in drug trafficking has become increasingly widespread. Narcoterrorism or drugrelated terrorism is a clear manifestation of the link between terrorism and transnational organized crime, which is reflected in two main concepts: Direct involvement of terrorists in the drug trade to finance their activities as well as the use of terrorist methods by drug trafficking organizations to facilitate the drug trade. Although the relationship and interaction between these two phenomena has been recognized globally, but the forms and nature of this interaction due to its ambiguity and complexity, has always been debated. The purpose of this study is to investigate the combination of terrorism and drug trafficking in a single phenomenon called narcoterrorism. It also provides an answer to the question of what is the link between these two global threats and, from the perspective of international law, what steps have been taken to combat this link. The findings of this study show that drug trafficking has become the most important source of funding for terrorist groups in the world. And as long as there is widespread supply and demand for drugs on a global scale, the fight against narcoterrorist threats will not be successful. In addition, the lack of a comprehensive and binding global legal document has made counterterrorism a problem. The present study is descriptive in nature and method and it is analytical and in terms of type, it is fundamental and the information contained in the research has been collected in a library method.
