الگوی مفهومی سیاست جنایی جرایم سایبری در ایران

امروزه، استفاده از فناوری اطلاعات و ارتباطات و بستر فضای سایبری در بسیاری‌از ابعاد زندگی بشر سایه افکنده است؛ به‌طوری‌که روابط افراد در این بستر منجر به شکل‌گیری عنوان &جوامع سایبری& گردیده‌است. بعد امنیت و نظم عمومی مهم‌ترین رکن در پایداری هر جامعه است؛ جوامع سایبری نیز از این امر مستثنی نبوده و به‌دنبال ترسیم سیاست جنایی خود برای تضمین امنیت جانی، مالی و حیثیتی شهروندان و نیز تامین امنیت نهادهای عمومی در بستر فضای سایبری هستند. در ایران نیز با توجه ضریب بالای نفوذ اینترنت و حجم وسیع کاربران، ترسیم سیاست جنایی برای مدیریت و پایش ناهنجاری‌های سایبری از اهمیت و اولویت به‌سزایی برخوردار است؛ بر این اساس، در این مقوله، با بررسی اسناد و مدارک و مطالعه کتابخانه‌ای، روندها و رویکردهای سیاست جنایی جمهوری اسلامی ایران در فضای سایبری تبیین گردیده و درنتیجه، الگوی مفهومی از سیاست نسبی جنایی مرتبط با فضای سایبری برای اقدامات علمی و عملی توسعه‌ای ارائه شده‌است.

Conceptual model of cybercrime criminal policy in Iran

Today, the use of information and communication technology and the cyberspace platform has overshadowed many aspects of human life; As the relationships of people in this context have led to the formation of the title of &cyber communities&. The dimension of security and public order is the most important element in the stability of any society; Cyber ​​communities are no exception to this and seek to outline their criminal policies to ensure the security of life, property and dignity of citizens as well as the security of public institutions in the context of cyberspace. In Iran, due to the high rate of Internet penetration and the large number of users, creating a criminal policy to manage and control cyber anomalies is of great importance and priority; Accordingly, in this category, by examining the documents and studying the library, the trends and approaches of the criminal policy of the Islamic Republic of Iran in cyberspace are explained, as a result, a conceptual model of relative cybercrimerelated criminal policy for scientific and practical development is presented.
