جرم، اقتصاد و پلیس مبارزه با جرایم اقتصادی در کشورهای مختلف؛ کارکردیابی پلیس اقتصادی در سطح جهانی

نیرویی که اهداف و وظایف خود را دنبال می‌کند، به فضا و شرایط تاثیرگذار اصلی، مستقیم و فوری حوزه فعالیت خود توجهی خاص دارد. پلیس نیز برای تحقق اهداف و انجام وظایف خود باید به عوامل تاثیرگذار اهتمام ورزد. به علت نقشی که شرایط اقتصادی در وقوع جرم یا بازدارندگی از جرم دارد، پلیس نمی‌تواند به این شرایط بی‏اعتنا باشد؛ به‌ ویژه که برخی عناصر اقتصادی در حوزه اصلی فعالیت پلیس قرار می‌گیرند. اگر جرم را اقدامی عقلایی مبتنی بر فرصت و مخاطره مجرم در نظر بگیریم، بنا بر انتظار و آن‏گونه که برخی مطالعات تجربی نشان می‌دهد، جرایم به ‌ویژه جرایم غیرخشونت‌بار‏ به شرایط اقتصادی وابسته‏اند. در کنار آنچه گفته شد، با معرفی جرایم اقتصادی، وظیفه پلیس در قلمرو اقتصاد، تبلور قانونی خاصی می‌یابد. با در نظر گرفتن پیشینه تاریخی، مبانی منطقی و نظری، تنوع اهداف و وظایف قانونی و مطالعات تجربی، کشورهای مختلف درصدد تشکیل نیرو و سازمانی برآمده‌اند که به عنوان پلیس، گارد و امثال آن، به صورت مسلح یا شبه‏‌نظامی و به صورت مستقل یا تحت تابعیت مقام رسمی خاص، در قلمرو اقتصاد و امور مالی و گمرکی به گونه‌ای تخصصی ورود یافته است. مروری بر وظایف مصرح و گزارش‌شدۀ پلیس اقتصادی‏ مالی گمرکی کشورهای بررسی‌شده نشان می‌دهد که فعالیت‌های بسیار متنوعی در حوزه مسئولیت این نیروی تجهیزشده برای رویارویی با جرایم اقتصادی تعریف شده است. این فعالیت‌ها از فعالیت‏های سلبی مبارزه با سرقت تا فعالیت مقابله‏‌جویانه با اقتصاد پنهان و امثال آنها تا فعالیت‏های ایجابی مراقبت در اجرای همگانی قوانین و مقررات اقتصادی، پولی، مالی و اعتباری را با ملاحظه ارتباط با سلامت، نظم و امنیت (آرامش و آسایش) عمومی و اجتماعی و اولویت مبارزه با فساد و جرایم سازمان‏یافته بزرگ اقتصادی و مالی شامل می‏شود.

An Examination of Economic Management in the Historical Background and a Practical Analysis of Police: Foundations of Economic Police

The origin and evolution of the organization called ‘police’, during Iran’s  history, direct attentions to the serious responsibility of this multidimensional  multifunctional force. Police was initially founded to manage urban  and rural areas and to guard ports. Throughout the history, it took on  various religious, political, military, and paramilitary aspects. Nowadays  police bears a wide variety of responsibilities, the extent of which is indefinite.  In Islamic societies, there had been figures assigned as ‘Mohtassib’  and ‘Shorteh’. Their responsibilities were similar to the responsibilities of  police in other countries. In preIslamic Iran, police was a disciplined influential  force adopting different names throughout history. The formation  of the first modern police, the establishment of ‘Jandarmerie Khazaneh’  (collecting tax and duty under the supervision of treasurer) coincided with  the formation of the Government Gendarmerie. Police’s responsibilities,  in a general classification, can be summarized as the formation, protection,  and promotion of order, security, and welfare. All of these are materialized  in the event that objective contexts are prepared and illegal activities  are countered, after due consideration. Furthermore, police is the general  bailiff of the judiciary system. It is authorized to act against all crimes. Its duties and authority are not limited to certain crimes. It is, in fact, an heir to  the Islamic system of ‘Hasbeh.’ This paper does not intend to show that police’s  responsibilities in the Islamic Republic of Iran are beyond the norms.  However, new responsibilities must be defined for police regarding the  country’s economy, its planned smart management during the increasing  foreign pressures, executive inefficiency and corruption in domestic areas,  and the Leader’s emphasis on the implementation of Resistance Economy.  The history of police in Iran and its legal functions show its high capacity.
