بایسته‌های حقوقی حاکمیت بر «جنة البقیع» بر پایه تجربه حمایت از «گورستان‌های تاریخی» در حقوق تطبیقی

گورستانهای تاریخی، مظهری از «تاریخ و تمدن»، «هویت» و «حق بر کرامت بازماندگان و مدفونان» است؛ از اینرو در نظامهای حقوقی مختلف بدان اهمیت داده شده و قواعد حقوقی متعددی به منظور صیانت و حراست از گورستانهای تاریخی و دسترسی بدان لحاظ شده است. بر همین اساس مسئله اصلی این نوشتار بررسی منطقه تاریخی بقیع به عنوان یکی از مقابر تاریخی مهم در پرتو سنجههای حقوق تطبیقی، رفتارها و قواعد حقوقی موضوعه در کشورهای مختلف است.نویسنده در این نوشتار توصیفی-تحلیلی در نهایت به این نتیجه دست یافته که حراست از گورستانهای تاریخی و جرمانگاری «تخریب و هتک حرمت» آن در کشورهای مختلف نشان از یک عرف مستمر و غیر سیال در نظامهای مختلف دارد. همچنین اصول متعددی در قبال بقیع باید مراعات شود که از آن جمله میتوان به «حق دسترسی و ارتفاق»، «مشارکت ذینفعان در اداره بقیع» و «منع استفاده زیانبار از این سرزمین» اشاره کرد.

the legal requirements for sovereignty over “al-baqī cemetery”based on the experience of maintenance of “historical cemeteries” in comparative law

historical cemeteries are a manifestation of &history and civilization&, &identity& and &the right to dignity of the survivors and the buried&. therefore, they have been given importance in various legal systems and numerous legal rules have been considered for the purpose of preserving and protecting historical cemeteries and access to them. accordingly, the main issue of this article is to examine the historical area of ​​baqi as one of the historical tombs of importance from various aspects in the light of comparative law standards and legal behaviors and rules established in different countries. this descriptive-analytical article has finally reached the conclusion that the protection of historical cemeteries and the criminalization of their &destruction and desecration& in different countries indicate a continuous and non-fluid custom in different systems. also, several principles are required for baqi, including the &right of access and easement&, &participation of stakeholders in the management of baqi& and &prevention of harmful use of this land&.
