چکیده
|
مدیریت گردشگری، نظام حقوق و تکلیف‌های دولت‌های زائرفرست و زائرپذیر، امکان سهیم شدن شهروندان دیگر کشورها پیروان سایر ادیان و مذاهب نسبت به قبرستان بقیع، جملگی مرتبط با مسئله «ماهیت و وضعیت حقوقی قبرستان بقیع» است؛ به همین دلیل این مقاله موضوع اصلی خود را بررسی ماهیت و وضعیت حقوقی آرامستان بقیع بر اساس یافته های تاریخی و فقهی و نیز تحلیل این سرزمین بر اساس نظام گزاره های سرزمینی حقوق بین‌الملل قرار داده است. از جمله نتایج این نوشتار توصیفی-تحلیلی می توان به ماهیت بین‌المللی سرزمین بقیع و احتساب آن در زمره منطقه بین‌المللی اشاره کرد که مدارک و ادله فقهی نیز این نظریه را تحکیم می‌کنند. در پی اثبات این ماهیت می توان به ترسیم نظام حقوقی حاکم بر این سرزمین از بُعد نظم حکمرانی، تنظیم گری در حوزه حق ها و تکلیف‌های گردشگران مذهبی و نیز دولت‌های اسلامی معاصر و... پرداخت.

The Nature and Legal Norms Governing the al-Baqīʿ Cemetery from the Perspectives of Jurisprudence and International Law Based on Islamic International Law

Abstract
|
The main purpose of this article is the investigation of the nature and legal status of the al-Baqīʿ cemetery based on the facts of history, jurisprudence, and analysis of this land based on the system of territorial propositions of international law because tourism management, the system of rights and duties of pilgrim-sender and pilgrim-receiver governments, and the possibility of participation of citizens of other states - followers of other religions - regarding the al-Baqīʿ cemetery- are related to the nature and legal status of this cemetery. The international character of al-Baqīʿ’s territory and its inclusion in the category of an international region are among the findings of this descriptive-analytical article and jurisprudential documents and proofs support this thesis. To demonstrate this, it is possible to describe the legal framework controlling this territory from the standpoint of governance, regulations regarding religious tourists’ rights and obligations, as well as modern Islamic governments.
