نقد و بررسی فقهی مبانی در وسعت و محدوده میقات ذوالحلیفه با تاکید بر آرای فقهای امامیه

سالانه هزاران مسلمان از نقاط مختلف دنیا در نقاطی که نامش میقات است، احرام می‌بندند تا راهی بیت‌الله الحرام شوند و یکی از بزرگ‌ترین رکن‌های شریعت را به‌جا آورند و به فرمان مسلّم قرآنی مبنی بر وجوب حج عمل کنند. بخش عمده‌ای از حجاج، از جمله ایرانیان، از مسیر مدینه راهی می‌شوند.پژوهش حاضر در نظر دارد تا میقات ذوالحلیفه و محوریت مسجد شجره در مشروعیت احرام اهل مدینه و حدود آن را بررسی کند. بنابراین محل بحث، لزوم احرام در داخل مسجد یا کفایت احرام از خارج یا هر نقطه از منطقه‌ ذوالحلیفه است. اهم نتایج به‌ دست آمده، این است که سه مبنا وجود دارد: اولی کل منطقه‌ ذوالحلیفه را و دومی خصوص مسجد را و سومی مسجد و مجاور آن را ملاک مشروعیت می‌داند. قول مختار، قول سوم است و این مبنا نوعی توسعه‌ موضوعی در مسئله است. اما مبنای توسعه‌ حکمی که مشروعیت احرام را از هر نقطه‌ ذوالحلیفه تا منطقه‌ بیداء جائز می‌شمرد، اگرچه از برخی نصوص ظاهر می‌شود، ولی مبنایی باطل است. اما توسعه‌ موضوعی حکم جواز احرام به گونه‌ای که خارج مسجد را شامل شود که همان مبنای سوم است، مبنایی صحیح و مستدل در مسئله است.
