زیارت بقیع؛ مطالعه عملکرد کشور عربستان در پرتو نظام بین‌المللی حقوق بشر

گردشگری، بسته به مقاصد و انگیزه‌های گردشگر، اصول و انگاره‌های متفاوتی از حیث حقوقی می‌یابد. گرچه به دلیل موضوعه نبودن قواعد حقوقی زیارت، تحلیل حقوقی حق‌های زائران با گزاره‌هایی بیشتر دکترینال و نیز عرفی همراه است، با این وجود به نظر می‌رسد عمده قواعد حقوق بین‌الملل گردشگری و اقتضائات حقوق بشری آزادی بیان، مذهب و عقیده در خصوص زائران بقیع قابل اجرا باشد. بر این اساس مسئله تحقیق حاضر، نخست تبیین ماهیت منطقه بقیع در چارچوب حقوق بین‌الملل، و سپس بررسی تکالیف دولت عربستان و برابر آن، حق‌ها و آزادی‌های زائران با تاکید بر عملکرد عربستان است. نگاشته پیش رو مبتنی بر روش توصیفی تحلیلی و کتابخانه‌ای، ماهیت سرزمین بقیع را از قبیل منطقه بین‌المللی (در صورت پیگیری) می‌داند و ضرورت برخورداری از حقوقی همچون رفتار برابر، حق کرامت، حق بروز رفتارهای تمدنی و آزادی ورود و خروج را مسلم می‌انگارد.

A Pilgrimage to Baqīʿ, the Study of Saudi Arabia’s Performance

Depending on a tourist’s destinations and intentions, tourism has different legal principles and ideas. Although, due to the lack of the subject matter of the legal rules of pilgrimage, the legal analysis of the pilgrims’ rights is accompanied by more doctrinal and customary propositions; the main rules of international law on tourism and the requirements of human rights regarding freedom of expression, religion and belief are applicable to the Baqīʿ pilgrims. Accordingly, the aim of this study is to explain the nature of the Baqīʿ region in the framework of international law and to analyze the duties of the Saudi government and the rights and freedom of the pilgrims with emphasis on the performance of Saudi Arabia. Based on a descriptiveanalytical method of research and the library sources, this research recognizes the nature of the Baqīʿ region as an international region and confirms the necessity of the rights such as equal treatment, dignity, civilized behaviors, and freedom to enter and exit.
