ابزارهای تضمین حق سلامت حجاج در آموزه های فقهی و اسناد حقوق بشری

یکی از اعمال عبادی سیاسی، که جایگاه ویژه‌ای در اسلام دارد، حج است. در این میان، حق سلامتی حاجیان در طول اعمال مناسک حج، عاملی مهم و تاثیرگذار تلقی می‌گردد. ازاینرو مقاله حاضر با روش توصیفی تحلیلی، ضمن پاسخ به سوال «چیستی ابزارهای تضمین حق سلامت حجاج در مکتب اسلام و نظام حقوق بشر،» به بررسی سازوکارهای حمایتی حقوق بشری در زمینه حق سلامت در مناسک حج می‌پردازد. بنابراین هدف این مقاله، بررسی تحلیلی ابزارهای تضمین حق سلامت در دو نظام مختلف است. بررسی‌ها نشان می‌دهد علیرغم تفوق و تفضل قوانین اسلامی و وجود کنوانسیون‌ها و حمایت‌های حقوقی بین المللی، حمایت‌های حقوقی دولت میزبان (عربستان) نواقص و کاستی‌هایی دارد. با این حال جهت تضمین حق سلامت حجاج و مقابله با موانع و چالش‌های روبه‌رو، بازنگری در فقه پویای تشیع، اجتهاد دینی، همفکری و همگرایی دولت‌های مسلمان، به ویژه دولت عربستان، در این حوزه لازم می‌نماید.

The right to health of the pilgrims in the Islamic perspective and international documents

Hajj, as one of the significant religiouspolitical practices, is of special importance in Islam. The pilgrims’ health right is considered as an important and effective factor in performing the rituals of Hajj. Therefore, explaining the nature of the tools to ensure the pilgrims’ health right in Islam and the system of human rights, this descriptiveanalytical study examines the human rightssupportive mechanisms regarding the health right in Hajj rituals.The study aims to analyze the tools of guaranteeing the health right in the two different systems. Studies show that, despite the priority of the Islamic rules and regulations and the existence of international conventions and legal protections, the legal protections of the host state (Saudi Arabia) suffer from shortcomings and deficiencies. However, to guarantee the pilgrims’ health right and remove the obstacles and challenges, it is necessary to rethink the dynamic Shi’ism, religious ijtihad, and sympathy and integration of Muslim states especially Saudi Arabia.
