نقش حکم حکومتی در ارتقای ابعاد سیاسی-اجتماعی حج و تطبیقات آن

ویژگی شاخص مناسک حج، گردهمایی مسلمانان از اقصا نقاط جهان در یک مکان است. اما احکام حکومتی، به مثابه اسناد بالادستی، بر آن نفوذ و تاثیر دارند؛ زیرا ولیّ فقیه حسب اوضاع جامعه انسانی، از سوی شارع، ماذون در صدور حکم مبتنی بر مصالح همگانی است و حج نیز از موضوعات مجرای حکم حکومتی است. این پژوهش، با روش توصیفی تحلیلی، به دنبال پاسخگویی به این سوال است که نقش احکام حکومتی در ارتقای ثمرات سیاسی و اجتماعی حج چیست. دستاوردهای تحقیق، حاکی از آن است که ثبوت هلال ذیالحجه، که نشان موعد برگزاری حج است، با تعیین و اعلام حاکم مخالف، حتی در صورت علم به مخالفت با واقع، صورت میگیرد؛ از سویی، گستره نفوذ احکام حکومتی در موضوع حج، فقط به تعلیق یا تعطیل کردن آن محدود نمیشود؛ بلکه حاکم اسلامی مجاز است با توجه به وسعت حکومت و تعدُّد موضوعات، که گاهی احکام آنها متعارض منافع همگانی قرار میگیرند، به اقتضای اوضاع اجتماعی، از تشرُّف به حج حامل مواد مخدر یا قاچاقچی کالا یا بدهکار مالیاتی، ممانعت به عمل آورد و با بازگشت منافع اجتماعی به مردم تحت حاکمیت اسلامی، مصالح عامه محقق شود.

The Role of Governmental Rule in Improving Political and Social Aspects of Hajj and its Implementations

The main specificity of the rites of hajj is the gathering of Muslims from all over the world in a single place. However, like the highlevel documents, the governmental rule can influence it; because, depending on the society’s condition, the guardian jurist by the permission of the holy lawgiver is allowed to issue rules, which are beneficial for the society, hence, Hajj is one of issues can be covered by the governmental rules. This descriptiveanalytical study aims at answering this question: what is the role of the governmental rules in improving the political and social outcomes of Hajj? The results of this study indicate that demonstration of Dhu’lHijjah crescent, which is the hallmark of Hajj time, is done through determination and declaration of the dissident ruler, even when it is proven that it is against the reality. On the other hand, the extent to which the governmental rules can influence the Hajj issue is not limited to suspension or cancellation of this ceremony, Regarding the governance extent and multiplicity of subjects, which sometimes their rules are against the public interest, depending on the social circumstances, Muslim ruler can prevent traffickers of drugs or goods or tax debtors from going to Hajj and realize the public interests through returning the social interest to people who are living in the Muslim society.
