بررسی فقهی وظیفه مرد صروره در حلق یا تقصیر

یکی از واجبات حج تمتع در روز دهم ذی الحجة در سرزمین منا، حلق یا تقصیر است. تقصیر بر همه زنان متعین است، اما در مورد وظیفه مردانی که قبلاً حجة الاسلام به جا نیاورده اند (صروره)، بین فقها اختلاف وجود دارد، که از اختلاف بدوی روایات نشات گرفته است. برخی از فقها معتقدند حلق بر صروره متعین است و برخی دیگر، صروره را نیز همچون سایر حجاج، مخیر بین حلق و تقصیر دانسته و حلق را تنها با فضیلت تر از تقصیر می دانند. پس از بررسی سندی و دلالی ادله طرفین، مشخص می شود که برخی از ادله نظریه اول از حیث سند و دلالت تام است، در نتیجه حلق بر صروره متعین است؛ زیرا روایات نظریه دوم، بر فرض صحت سند و دلالت، تنها اطلاقاتی هستند که توسط روایات نظریه اول، تقیید می خورند.

Jurisprudential Analysis of a Sarureh Man Duty to Halgh or Taghsir

Halgh or Taghsir is one of imperatives of Tamatoe Hajj in tenth of Dhu’lHijjah in Mena land. Taghsir is imperative for all women, but there is a dissention among Islamic jurisprudents on duty of men who have not conducted Hajj already )Sarureh(, which is rooted in the primitive discord in the carious narratives.Some jurisprudents believe that Halgh is imperative for the Sarureh, but other say that like other Hojaj, the Sarureh is allowed to choose between halgh and taghsir and they consider Halgh as something more virtual.After analyzing the documents and reasons of both parts it will be clear cut that some reasons of the first theory are complete in terms of authenticity and reasonability, so, halgh is imperative for the Sarureh; because the narratives of the second theory, as we consider appropriate their authenticity and reasonability, are just generalities which are limited by the narratives of the first theory.
