بررسی اختیارات حاکم اسلامی در حکم جهاد دفاعی از منظر فقه امامیه

موضوع دفاع و آمادگی جامعه اسلامی برای جهاد در راه خدا، از ضروریات بقا و امنیت امت اسلامی است. این پژوهش با هدف بررسی جایگاه و اختیارات حاکم اسلامی در صدور حکم جهاد دفاعی در انواع مختلف آن، در مبانی اسلامی و آراء و نظرات فقهی علمای اسلام انجام پذیرفته است. پژوهش از نوع بنیادی و کاربردی بوده، با مراجعه به منابع و متون اسلامی و فقهی به روش کتابخانه‌ای و تحلیلی انجام شده است. از بررسی متون دینی و فقهی چنین برمی‌آید که اولاً حاکم اسلامی نقش کلیدی در اجرای حکم جهاد و دفاع از کیان حکومت اسلامی و عزت مسلمانان داشته، ثانیاً این اختیارات ضامن تامین امنیت امت اسلام و حفظ استقلال و بقای آن است؛ ثالثاً اختیارات حاکم اسلامی، با در نظر گرفتن شرایط زمانی و مکانی و معطوف به پویایی فقه شیعه، عامل اصلی در بسیج نیروها برای مقابله با دشمنان اسلام است؛ و رابعاً این احکام فصل الختام جاری شدن حکم جهاد دفاعی در حکومت اسلامی است.
