روش‌ شناسی و ابزار تحقیق در حقوق نفت و گاز

«حقوق نفت و گاز» رشته جدید میان‌رشته‌ای در علم حقوق است که در سال‌های اخیر برای اولین بار در بین کشورهای نفت‌خیز خاورمیانه در دانشگاه تهران معرفی و تاسیس شد. این رشته از یک‌‌‌ سو متاثر از حوزه‌های گوناگون علم حقوق از جمله «حقوق خصوصی» و «حقوق بین‌الملل ‌سرمایه‌گذاری» در تحلیل رابطۀ فی‌‌مابین شرکت ملی نفت با «شرکت بین‌المللی نفتی است و از سوی دیگر متاثر از حقوق عمومی در مقام تحلیل رابطۀ فی‌مابین شرکت بین‌المللی نفتی با دولت یا کشور میزبان است. با توجه به ماهیت و خصلتِ بین‌المللی حقوق نفت و گاز، ادبیات این رشته می‌تواند زودتر از سایر رشته‌های محض حقوقی جنبه کاربردی پیدا کند. به سبب ماهیت بین‌رشته‌ای بودن حقوق نفت و گاز، ابزارهای تحقیق در این رشته متنوع است. در این مقاله به چهار روش حقیقی «انتزاعی»، «تمثیلی»، «رویه‌ای» و «استقرایی» پرداخته و ضمن تعریف روش‌های مزبور، مزایای هریک بررسی می‌شود.

Research methodology in oil and gas law course

Oil and Gas Law Course is an interdisciplinary branch of law which has been recently, for the first time in the Middle East States, introduced and established in Tehran University. This Course deals with various aspects of law, including "private law" and "international investment law" while dealing with the NOC with IOC, relationship and "public Law" while dealing with the host government (HG) and IOC relationship. On the one hand, since this Course has an international nature and character, thus it should be looked upon and studied as practical and operational. On the other hand, since this Course is a multidisciplinary course, its research methodology should be different from an ordinary law course. In this article, four methods including "Abstract", "Allegory," "Procedural" and "Deductive" will be discussed and the advantages and disadvantages of each will be studied.
