بررسی قراردادهای مهندسی، اجرا و ساخت با شرط تامین مالی(Epcf) در نظام نوین قراردادهای صنعت نفت

امروزه شیوه‌های متنوعی از قراردادهای بین‌المللی در صنعت نفت و گاز مورد استفاده شرکت‌های نفتی و سرمایه‌گذاران قرار می‌گیرد. با توجه به مشکلات موجود در تامین منابع مالی اجرای پروژه‌ها در صنعت نفت، شناسایی شیوه‌های جدید قراردادی که حضور فعال‌تر بخش خصوصی در این زمینه را دربر داشته باشد ضروری است. قراردادهایepcf  نمونه مناسبی است که در شرایط موجود می‌تواند به‌مثابه شیوه‌ای موثر مدنظر قرار گیرد. البته با توجه به عدم طی سیر تکاملی این شیوه قراردادی در صنعت نفت، پیاده‌سازی آن در عمل مشکلاتی را به همراه دارد؛ زیرا تنوع بالای فعالیت‌ها در این روش خطاهای مدیریتی پیمانکار را افزایش می‌دهد و جدید بودن این شیوه ضعف‌های حقوقی و قراردادی را برجسته‌تر می‌کند. هم‌چنین شناسایی حقوق و تکالیف طرفین قرارداد و نحوه اعمال این شیوه را تحت تاثیر قرار می‌دهد.

Areview of engineering, procurement, construction and finance (EPCF) contracts in the new system for oil industry contracts

Nowadays,  various methods of international contracts in the oil and gas industry can be used by the oil companies and investors. According to the project finance problems in the oil industry, it is necessary to identify the new model contracts that can lead to more active participation of the private sector in the project finance. In this situation, the EPCF contract can be appropriate for solving the project finance problems. However, due to the lack of development of this contractual model in the oil industry, its implementation will be difficult and complicated. The wide diversity of activities in this method increases the management mistakes of contractor and this new method will cause  legal and contractual deficiency; also it will  affect  the determination of the rights and obligations of the parties and the implementation of this method.
