تمیز منابع قانونی حاکم بر ملاحظات زیست ‌محیطی قراردادهای epc صنعت نفت‌‌ و گاز ایران

شناسایی ملاحظات زیست‌ محیطی و الزامات قانونی حاکم بر آن در قراردادهای مهندسی، تامین کالا، خدمات و ساخت (epc) دارای اهمیت ویژه‌ای است. اجرای پروژه‌های صنعت نفت‌وگاز ایران به روش قراردادهای یادشده، امری رایج است که یکی از ابهامات آن‌ها، شناسایی ملاحظات زیست‌محیطی و تمیز الزامات حاکم بر آن است. ازاین‌رو، نخست به تبیین موضوع‌هایی همچون پیشگیری از آلایندگی محیط‌زیست، مدیریت پسماند، برنامه‌ریزی برای مدیریت مواد خطرناک، بازگرداندن زیست‌بوم به حالت اولیه و برچیدن کارگاه و شناورهای تولیدی پرداخته و سپس، به این پرسش‌ها پاسخی کارا داده می‌شود که: اولاً، آیا مصادیق فوق از الزامات آمره‌ قانونی برخوردار است؟ ثانیاً، گستره‌ این منابع قانونی تا کجا ادامه دارد؟ محدود به حقوق داخلی است و یا می‌توان به اسناد بین‌المللی نیز تمسک جست؟ فرضیه‌ نخست پژوهش پیشِ‌رو، آن است که ملاحظات زیست‌محیطی یادشده، از الزامات آمره‌ قانونی برخوردارند. فرضیه‌ دوم نیز قائل به تفکیک منابع داخلی از اسناد بین‌المللی مرتبط با ملاحظات زیست‌محیطی است. به‌سخن‌دیگر، بسته به اجرای پروژه به روش epc در مناطق خشکی و دریا، الزامات قانونی حاکم نیز تغییر می‌کنند.

identifying environmental considerations and the legal requirements governing engineering, procurement, and construction (epc) contracts is of particular importance. the implementation of iranian oil and gas industry projects through epc contracts is common, and one of the key ambiguities in these contracts lies in identifying environmental considerations and clarifying the requirements that govern them. for this reason, issues such as preventing environmental pollution, managing waste, planning for hazardous materials management, restoring the ecosystem to its original state, and dismantling workshops and production vessels are first examined. subsequently, two key questions are addressed: do the above examples fall under mandatory legal requirements? to what extent do these legal requirements apply—are they limited to domestic law, or can international documents also be relied upon? the first hypothesis of this study is that the aforementioned environmental considerations are subject to mandatory legal requirements. the second hypothesis proposes a distinction between domestic legal sources and international documents related to environmental considerations. in other words, depending on whether the project is implemented using the epc method in onshore or offshore settings, the applicable legal requirements may vary.
