مسئله مالکیت در طرح‌ های ذخیره‌ سازی زیرزمینی گاز طبیعی در مخازن تخلیه شده ‌هیدروکربنی

به‌رغم اهمیت و نقش راهبردی صنعت ذخیره‌ سازی زیرزمینی گاز طبیعی، متاسفانه بستر قانونی لازم برای توسعه‌حداکثری این صنعت فراهم نشده و سیاست‌گذاران در سطح کلان ملی، توجه کافی به این مسئله‌راهبردی نداشته‌اند. حضور فعال بخش خصوصی در این صنعت، منوط به شناسایی حقوق مرتبط با ذخیره‌سازی است. هدف اصلی از انجام این پژوهش، بررسی ابعاد حقوقی مالکیت در صنعت ذخیره‌سازی زیرزمینی گاز طبیعی در مخازن تخلیه‌شده‌هیدروکربنی است.  روش انجام این پژوهش، توصیفی-تحلیلی و روش اصلی گردآوری اطلاعات، کتابخانه‌ای بوده و از تجزیه‌وتحلیل آرای داوری، استدلال‌های عقلی، اصول و قواعد حقوقی و فقهی نیز بهره گرفته‌ شده ‌است. در این پژوهش ضمن بررسی حقوق ذخیره‌سازی مشتمل‌بر حقوق تحت‌الارضی، حقوق سطح‌الارضی و سایر حقوق مرتبط با عملیات، نظام حقوقی مالکیت بر مخزن، هیدروکربن درجا و هیدروکربن استحصالی از مخزن ذخیره‌سازی که متشکل از گاز تزریقی و محتوای بومی مخزن است، حسب مورد و به تفکیک شناسایی و احصا شده است.

ownership issue in underground gas storage (ugs) in depleted oil and gas reservoirs

objective: despite the strategic importance of the underground gas storage (ugs) industry, a suitable legal framework for its development has not yet been established, and national policymakers have largely overlooked this critical issue. active private sector participation in this industry hinges on recognizing rights associated with ugs. this study aims to explore the legal aspects of ownership in the underground natural gas storage industry, particularly within depleted oil and gas reservoirs.methodology: the research employs a descriptive-analytical approach, with primary data collection conducted through library research. the study also analyzes arbitral awards, logical arguments, and relevant legal and jurisprudential principles.conclusions: this research examines various gas storage rights, including mineral rights, surface rights, and other operational rights. it identifies and categorizes the legal regime of ownership regarding the reservoir, oil in place, injected gas, and withdrawal hydrocarbons (comprising injected gas and the native content of the reservoir) on a case-by-case basis.
