دولت به‌منظور حفاظت از آبخوان‌های فرامرزی و جلوگیری از آلودگی آن‌ها، وظایفی را برعهده دارد. این وظایف به‌موجب قوانین و مقررات بین‌المللی تبیین شده است. اگرچه در حوزه ی داخلی، قوانین مرتبط ازجمله قانون توزیع عادلانه ی آب، وظایف و اختیارات دولت را به‌خوبی مشخص کرده است. اما با توجه به پراکندگی مقررات بین‌المللی، وظایف برون‌مرزی دولت با ابهام روبه‌رو شده است. اصول مندرج در کنوانسیون‌های بین‌المللی در حوزه ی آبخوان‌ها و محیط‌زیست، مهم‌ترین تکالیف برای صیانت از آبخوان‌های فرامرزی است؛ زیرا غالباً مقررات بین‌المللی بر پایه ی اصولی که در این مقاله به آن خواهیم پرداخت، تدوین شده‌اند. این نوشتار با معرفی و بررسی اصول مندرج در قوانین و مقررات بین‌الملل، وظایف و تعهدات دولت را در حفاظت از آبخوان‌های فرامرزی مورد شناسایی قرار می‌دهد.
