چالش های حقوقی استفاده از روش های بانکی جایگزین در دریافت ‏وجوه حاصل از فروش نفت خام و فرآورده های نفتی در شرایط ‏تحریمی

تحریم‌های اقتصادی آمریکا در حوزه‌ بانکی، صنعت نفت ایران را بیش از هر صنعت دیگری آسیب پذیر کرده است. درواقع تحریم‌های ثانویه‌ آمریکا، نه تنها بانک‌های غیرآمریکایی را از هرگونه مبادلات بانکی با ایران منع می‌کند، بلکه ممنوعیت دسترسی به ارزهای قوی را نیز مقرر کرده است. مقاله‌ پیش رو می‌کوشد برخی از روش‌هایی را که ایران در برخورد با تحریم‌های بانکی آمریکا برای دسترسی به مهم ترین منبع درآمدی خود (درآمدهای نفتی) به کار گرفته است، از منظر عملی تحلیل کرده و راهکارهایی که امکان استفاده برای دریافت وجوه حاصل از فروش نفت خام را داراست، مورد بررسی قرار دهد.

abstractus economic sanctions on the iran’s banking sector have made iran’s oil industry more vulnerable than any other industry. in fact, us secondary sanctions, such as extraterritorial sanctions, not only bar non-us banks from any banking transactions with iran, but also ban iranian entities from access to strong currencies. the present article reviews, from a practical point of view, certain methods that iran has used in the face of us banking sanctions to access its most important source of income; i.e., the oil revenues and examines the banking and non-banking solutions and alternatives that has been used by iran to receive the proceeds of sale of crude oil and oil products.
